 1        AN ACT concerning finance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  State  Prompt Payment Act is amended by
 5    adding Section 8 as follows:

 6        (30 ILCS 540/8 new)
 7        Sec. 8.  Priority of payment. A voucher for  payment  for
 8    goods or services furnished to the State by a small business,
 9    a  not-for-profit  entity,  or  a  health  care  provider and
10    submitted by an official or agency  to  the  Comptroller  for
11    payment  must  be  given  priority  in  payment.  Any voucher
12    meeting these criteria that is submitted to  the  Comptroller
13    by  an  official or agency for payment from a given fund must
14    be paid before any other bill or invoice is  paid  from  that
15    fund. If 2 or more vouchers eligible for priority payment are
16    received  by  the Comptroller in the same day for payment out
17    of the same fund and there is not enough money in the fund to
18    pay them all, then each bill or invoice shall be paid in  the
19    order in which it is received.
20        The  Comptroller shall, by rule, determine those entities
21    that meet the definition of "small business", "not-for-profit
22    entity", or "health care provider".
