Synopsis As Introduced
Amends the Code of Civil Procedure. Provides that the mortgagee, judgment creditor, or other lien holder shall furnish the confirmation order to the last-known insurer of a residential building in writing by first-class mail after the mortgagee, judgment creditor, or lien holder becomes the mortgagee-in-possession. Provides that the failure to send or receive a copy of the order does not affect the rights of the mortgagee or purchaser or affect the foreclosure proceedings. Makes other changes. Effective January 1, 2012.

House Committee Amendment No. 1
Further amends Code of Civil Procedure. Adds to the designated entities (the last known property insurer and the identified public officials) who shall be sent a copy of a notice of foreclosure and a confirmation order, in the case of a municipality with a population of more than 2,000,000, the alderman for the ward in which the property is located.

House Floor Amendment No. 2
Further amends the Code of Civil Procedure. Deletes requirement that the last-known property insurer of the mortgaged real estate must be sent a copy of the notice of foreclosure.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause with provisions similar to the bill except that it provides that the notice of foreclosure shall be sent to the appropriate governmental official considering where the property is located, namely the chairperson of the county board or the county clerk, the mayor or city clerk of a city and in the case of a city with a population over 2 million also to the alderman for the ward in which the property is located, or the president or clerk of a town or village (instead of to the alderman for the ward in which the property is located in a municipality with a population over 2 million). Provides that a notice of a confirmation order of a judicial sale shall also be sent to the chairperson of the county board or the county clerk, the mayor or city clerk of a city, or the president or clerk of a town or village.
