 1                    AMENDMENT TO SENATE BILL 2214

 2        AMENDMENT NO.     .  Amend Senate Bill 2214, AS  AMENDED,
 3    by inserting after the end of Article 10 the following:

 4                             "ARTICLE 20

 5        Section  20-1.  The Director of the Department of Natural
 6    Resources, on behalf of the State of Illinois, is  authorized
 7    to  Convey  and  Quit Claim unto the City of Granite City, an
 8    Illinois  unit  of  local  government,  its  successors   and
 9    assigns,  for  and  in  consideration  of  $1.00 paid to said
10    Department, a non-exclusive, unobstructed, perpetual easement
11    for the purpose of constructing, installing, or  laying,  and
12    thereafter    using,    operating,   inspecting,   repairing,
13    maintaining, and replacing a storm water ditch or  sewer  on,
14    over,  under,  and  across  all  or  part  of  the  following
15    described real property, subject to such conditions as may be
16    deemed  necessary  by  said  Department to protect the public
17    interest, to wit:
18             An 80-foot wide tract of land being 40 feet wide  on
19        either  side  of a centerline located in the West Half of
20        Section 15, Township 3 North, Range 9 West of  the  Third
21        Principal   Meridian,   Madison  County,  Illinois,  said
22        centerline being more fully described as follows:

 1             Commencing at the Southeast corner of the  Northwest
 2        Quarter  of  the  Northwest  Quarter  of said Section 15;
 3        thence North  along  the  East  line  of  said  Northwest
 4        Quarter  of  the  Northwest  Quarter  of  Section  15,  a
 5        distance  of  574.2  feet to a point on the southeasterly
 6        right-of-way line of the former  Nickel  Plate  Railroad;
 7        thence  Southwesterly  along  said  right-of-way  line, a
 8        distance of 69.04 feet to a point on the centerline of  a
 9        tract of land conveyed to the Alton and Southern Railroad
10        Company  by  deed  recorded  in Book 550, Page 167 in the
11        records of Madison County, Illinois, and being the  Point
12        of  Beginning  of  the centerline being described; thence
13        South along the centerline of said tract conveyed to  the
14        Alton  and  Southern Railroad Company, a distance of 2700
15        feet, more or less, to a point on the Northerly shoreline
16        of Horseshoe Lake, being the  Termination  Point  of  the
17        centerline being described;
18             Said  80-foot  wide tract being bounded on the North
19        by the Southeasterly  right-of-way  line  of  the  former
20        Nickel  Plate Railroad, and on the South by the Northerly
21        shoreline of Horseshoe Lake.

22        Section 20-900. The Director of Natural  Resources  shall
23    obtain   a  certified  copy  of  the  portions  of  this  Act
24    containing the title, enacting clause,  the  effective  date,
25    the  appropriate  Section  or  Sections  containing  the land
26    descriptions of the property to be transferred  or  otherwise
27    affected  under this Article, and this Section within 60 days
28    after its effective date and, upon  receipt  of  the  payment
29    required  by  the  Section  or  Sections,  if  any payment is
30    required,  shall  record  the  certified  document   in   the
31    Recorder's Office in the county in which the land is located.

 1        Section  25-5.  The Director of the Department of Natural
 2    Resources, on behalf of the State of Illinois, is  authorized
 3    to  execute  and  deliver  to  the  Plainfield  Township Park
 4    District, for  and  in  consideration  of  $1  paid  to  said
 5    Department, a quit claim deed to the following described real
 6    property, to wit:
 7        TRACT IA (EAST):
 8        That  part  of the following described parcel lying North
 9        of the Indian Boundary Line of the North 22 chains of the
10        Northwest fractional 1/4 of Section  3,  in  Township  36
11        North  and  in  Range  9  East  of  the  Third  Principal
12        Meridian, described as follows:
13        Commencing  at  a  point 22 chains South of the Northwest
14        corner of said Northwest fractional  1/4  of  Section  3,
15        thence  East parallel with the North line of said Section
16        3, (North 90 degrees East) 975.64 feet,  to  a  point  of
17        beginning; thence North 90 degrees East, 1667.55 feet, to
18        the East line of Northwest fractional 1/4 of said Section
19        3; thence North 00 degrees 09 minutes 46 seconds West, 22
20        chains,  to the North line of Northwest fractional 1/4 of
21        said Section 3; thence  South  90  degrees  West,  928.19
22        feet;  thence  South  08 degrees west, 100.0 feet; thence
23        South 10 degrees 32 minutes West 67.97 feet; thence South
24        25 degrees West, 500.0  feet;  thence  South  36  degrees
25        West,  300.0  feet;  thence  South 30 degrees West, 300.0
26        feet; thence South 23  degrees  30  minutes  West,  300.0
27        feet;  thence  South  43  degrees West, 75.70 feet to the
28        Point of Beginning;
29        TRACT 1B:
30        That part of the following described parcel  lying  South
31        of the Indian Boundary Line:
32        The  North  22 chains of the Northwest fractional Quarter
33        of Section 3, in Township 36 North and in Range 9 East of
34        the Third Principal Meridian;

 6        described as follows: Commencing at  a  point  22  chains
 7        South   of   the   Northwest  corner  of  said  Northwest
 8        fractional 1/4 of Section 3, running  thence  South  3.82
 9        1/3 chains (South 00 degrees 09 minutes 46 seconds East);
10        thence  East parallel with the North line of said Section
11        3, (North 90 degrees East) 755.0  feet,  to  a  point  of
12        beginning;  thence  North  90  degrees  East 894.14 feet;
13        thence South parallel with the West line of said  Section
14        3,  8.19 chains to a stone on the West Bank of the DuPage
15        River; thence East, 6.50 chains; thence North 70  degrees
16        East, 8.50 chains; thence West, 2.80 chains to the center
17        thread  of  the  DuPage  River;  thence  along the center
18        thread of the said river North 32 degrees East, 6 chains;
19        thence  North  13  degrees  East,  4.25  chains  to   the
20        Northeast  corner  of  said Tract in the center thread of
21        the said river; thence West parallel to the North Section

25        TRACT 2B:

30        Principal  Meridian, described as follows: Beginning at a
31        point 22 chains South of the  Northwest  corner  of  said
32        Northwest  fractional  1/4  of  Section 3, running thence
33        South 3.82 1/3 chains;  thence  East  parallel  with  the
34        North  line  of  said Section, 25.29 chains; thence South

11        TRACT 3A:
12        That part of the following described parcel  lying  North

14        That  part  of  the West 1/2 of the Northeast 1/4 of said
15        Section 3, lying West of the center thread of the  Dupage
16        River,  in  Township  36 North and in Range 9 East of the
17        Third Principal Meridian;
18        TRACT 3B:
19        That part of the following described parcel  lying  South
20        of the Indian Boundary Line:
21        That  part  of  the West 1/2 of the Northeast 1/4 of said
22        Section 3, lying West of the center thread of the  DuPage
23        River,  in  Township  36 North and in Range 9 East of the
24        Third Principal Meridian;
25        Containing  in  all  74.771  acres,  more  or  less,  all
26        situated in Will County, Illinois.

27        Section   25-10.  The   conveyance   of   real   property
28    authorized by Section 25-5  shall  be  made  subject  to  the
29    condition  that  said  real  property  shall  be used for the
30    promotion, protection and preservation of  wildlife  and  the
31    setting aside of the real property for open space and outdoor
32    recreational  activities  specifically  that  the part of the
33    74.771 acres lying in the flood plain  and  adjacent  to  the

 1    DuPage  River  shall  be set aside and left as best it can in
 2    its natural state, though permitting its limited  development
 3    with  walking  and  hiking  paths  and  that that part of the
 4    74.771 acres lying west of the west flood plain line adjacent
 5    to the DuPage River may be used for open  space  and  outdoor
 6    recreational   activities,   including  the  construction  of
 7    parking  lots,  washrooms,   picnic   grounds   and   outdoor
 8    recreational  facilities  and  buildings  ancillary  thereto,
 9    reference  being  had  to  that  Order  of  Distribution  and
10    Settlement  entered May 14, 1997, in the Circuit Court of the
11    12th Judicial Circuit, Will County, Illinois, in Case  Number
12    95-PE-3202.

13                             ARTICLE 30

14        Section  30-10.  The  Director  of  Natural Resources, on
15    behalf of the State of Illinois, is authorized to execute and
16    deliver to Elmer L. Hamson, his successors and  assigns,  for
17    and  in consideration of $8,580.00 paid to said Department, a
18    quit claim deed to the following described real property,  to
19    wit:
20        Parcel 1: A strip of land 160 feet in width, described as
21        follows:   Beginning  at  the  Southeast  corner  of  the
22        Southeast Quarter of the Southwest Quarter of Section 11;
23        thence North, a distance of 1478.41 feet to  a  point  on
24        the  South  line  of  the existing township road right of
25        way; thence running North 55 degrees 4 minutes West along
26        said South line of the  township  road  right  of  way  a
27        distance  of 195.16 feet to a point; thence running South
28        to the  South  line  of  the  Southeast  Quarter  of  the
29        Southwest  Quarter;  thence East 160 feet to the point of
30        beginning; ALSO, a  strip  of  land  160  feet  in  width
31        extending  over  and  across the East 3/4ths of the North
32        Half of the Southwest Quarter of Section  11,  the  South

 1        boundary  of  same  being  the South line of the existing
 2        township road right of way, said  160  foot  strip  being
 3        more particularly described as follows, to-wit: Beginning
 4        at  a  point  being  1478.41  feet North of the Southeast
 5        corner of the Southeast Quarter of the Southwest Quarter,
 6        said point being  on  the  South  line  of  the  existing
 7        township  road  right  of  way;  thence  running North 55
 8        degrees 4 minutes West along  said  South  township  road
 9        right  of way line, a distance of 2015.07 feet to a point
10        on the  North  line  of  the  Northwest  Quarter  of  the
11        Southwest  Quarter  of  said  Section  11;  thence East a
12        distance of 279.42 feet to a point; thence running  South
13        55  degrees 4 minutes East to a point on the East line of
14        the Northeast Quarter of the Southwest Quarter of Section
15        11; thence South a distance of 195.16 feet to  the  point
16        of  beginning;  all situated in Township 4 South, Range 4
17        East  of  the  Third  Principal  Meridian,  In  JEFFERSON
18        COUNTY, ILLINOIS; EXCEPT all minerals and all rights  and
19        easements in favor of said mineral estate;
20        ALSO,
21        Parcel  1 minerals: An undivided 1/2 interest in all coal
22        within 150 feet of the surface as  to  the  following:  A
23        strip  of  land  160 feet in width, described as follows:
24        Beginning  at  the  Southeast  corner  of  the  Southeast
25        Quarter of the Southwest Quarter of  Section  11;  thence
26        North, a distance of 1478.41 feet to a point on the South
27        line  of  the existing township road right of way; thence
28        running North 55 degrees 4 minutes West along said  South
29        line  of  the  township  road right of way, a distance of
30        195.16 feet to a point; thence running South to the South
31        line of the Southeast Quarter of the  Southwest  Quarter;
32        thence  East 160 feet to the point of beginning; ALSO, as
33        to a strip of land 160 feet in width extending  over  and
34        across the East 3/4ths of the North Half of the Southwest

 2        the South line of the existing  township  road  right  of
 3        way,   said   160  foot  strip  being  more  particularly
 4        described as follows, to-wit; Beginning at a point  being

 6        Southeast  Quarter  of  the Southwest Quarter, said point
 7        being on the South line of  the  existing  township  road
 8        right  of  way; thence running North 55 degrees 4 minutes
 9        West along said South township road right of way line,  a
10        distance  of 2015.07 feet to a point on the North line of
11        the Northwest Quarter of the Southwest  Quarter  of  said
12        Section  11;  thence East, a distance of 279.42 feet to a
13        point; thence running South 55 degrees 4 minutes East  to
14        a  point on the East line of the Northeast Quarter of the
15        Southwest Quarter of Section 11; thence South a  distance
16        of 195.16 feet to the point of beginning; all situated in
17        Township  4  South,  Range  4 East of the Third Principal
18        Meridian, in JEFFERSON COUNTY, ILLINOIS.

19        Section 30-15.  The Director  of  Natural  Resources,  on
20    behalf of the State of Illinois, is authorized to execute and
21    deliver  to Harold Haile, his successors and assigns, for and
22    in consideration of $3,460.00 paid to said Department, a quit
23    claim deed to the following described real property, to wit:
24        Parcel 2: A strip of land 160  feet  in  width  extending
25        over  and  across  the Southwest Quarter of the Northwest
26        Quarter  of  Section  11,  running  in  a   Southeasterly
27        direction, the South line of same being the South line of
28        the  existing  township  road right of way, said 160 foot
29        strip  being  more  particularly  described  as  follows:
30        Beginning  at  a  point  being  627  feet  South  of  the
31        Northwest  corner  of  the  Southwest  Quarter   of   the
32        Northwest  Quarter of Section 11, said point being on the
33        South line of the existing township road  right  of  way;

 1        thence running South 55 degrees 4 minutes East along said
 2        South  line of the township road right of way, a distance
 3        of 1193.93 feet to a point  on  the  South  line  of  the
 4        Southwest  Quarter  of  the  Northwest  Quarter  of  said
 5        Section  11;  thence East, a distance of 279.42 feet to a
 6        point; thence running North 55 degrees 4 minutes West  to
 7        the  West  line of the Southwest Quarter of the Northwest
 8        Quarter of said Section 11 at a point being  195.16  feet
 9        North of the point of beginning; thence South, a distance
10        of  195.16  feet to the point of beginning; in Township 4
11        South, Range 4 East of the Third Principal Meridian,  all
12        situated   in  JEFFERSON  COUNTY,  ILLINOIS,  EXCEPT  all
13        minerals and all rights and easements in  favor  of  said
14        mineral estate;

16        Parcel  2  minerals:  All  coal  within  150  feet of the
17        surface as to the following: A strip of land 160 feet  in
18        width  extending over and across the Southwest Quarter of
19        the  Northwest  Quarter  of  Section  11,  running  in  a
20        Southeasterly direction, the South line of same being the
21        South line of the existing township road  right  of  way,
22        said  160 foot strip being more particularly described as
23        follows: Beginning at a point being 627 feet South of the
24        Northwest  corner  of  the  Southwest  Quarter   of   the
25        Northwest  Quarter of Section 11, said point being on the
26        South line of the existing township road  right  of  way;
27        thence running South 55 degrees 4 minutes East along said
28        South  line of the township road right of way, a distance
29        of 1193.93 feet to a point  on  the  South  line  of  the
30        Southwest  Quarter  of  the  Northwest  Quarter  of  said
31        Section  11;  thence East, a distance of 279.42 feet to a
32        point; thence running North 55 degrees 4 minutes West  to
33        the  West  line of the Southwest Quarter of the Northwest

 5        Section 30-900. The Director of Natural  Resources  shall
