 1        AN ACT in relation to local government officers.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Counties  Code  is  amended  by  changing
 5    Sections 3-3009, 3-3010, 5-1103.1, and 5-5001 as follows:

 6        (55 ILCS 5/3-3009) (from Ch. 34, par. 3-3009)
 7        Sec.   3-3009.  Deputy  coroner's,  sheriff's  or  police
 8    officer's performance of coroner's duties.  If  there  is  no
 9    coroner,  or it shall appear in like manner that he is also a
10    party to or interested in the suit, or of kin, or partial  to
11    or  prejudiced  against  either  party,  process  may in like
12    manner issue to the  deputy  coroner  if  designated  by  the
13    coroner  to  fill the vacancy, or, if no designation is made,
14    to any sheriff, sheriff's deputy or police  officer,  in  the
15    county,  who  shall  perform  like  duties as required of the
16    coroner. The designation shall be in writing and  filed  with
17    the county clerk.

19        (55 ILCS 5/3-3010) (from Ch. 34, par. 3-3010)
20        Sec. 3-3010.  Deputy sheriff, undersheriff, or coroner to
21    act  when  sheriff's  office  vacant. Where the office of the
22    sheriff is vacant, the chief deputy sheriff  or  undersheriff
23    if  designated  by the sheriff to fill the vacancy, or, if no
24    designation is made, the coroner of the county shall  perform
25    all  the  duties  required  by  law  to  be  performed by the
26    sheriff, and have the same powers, and be liable to the  same
27    penalties  and  proceedings  as  if  he  were  sheriff, until
28    another sheriff is elected or appointed  and  qualified.  The
29    designation  shall  be  in  writing and filed with the county
30    clerk.

 2        (55 ILCS 5/5-1103.1) (from Ch. 34, par. 5-1103.1)
 3        Sec.  5-1103.1.   Contract  for  police  protection.   In
 4    counties  having fewer than 1,000,000 inhabitants, the county
 5    board may contract, with advice and consent of the sheriff in
 6    the county in which the  request  for  contract  services  is
 7    made,  based upon a determination of law enforcement needs of
 8    the area in which contract services are sought, with  one  or
 9    more  incorporated  municipalities  lying  wholly  or  partly
10    within the county to furnish police protection in the area of
11    the  county  that  is not within the incorporated area of any
12    municipality having a regular police department.

15        Sec.  5-5001.  Police  protection  in  townships  outside
16    incorporated municipalities. The county board of  any  county
17    may  contract,  with advice and consent of the sheriff in the
18    county in which the request for contract  services  is  made,
19    based  upon  a  determination of law enforcement needs of the
20    area in which contract services are sought, with any township
21    in the county to furnish police  protection  outside  of  any
22    incorporated municipality in the township.

24        Section  10.   The  Township  Code is amended by changing
25    Section 30-150 as follows:

26        (60 ILCS 1/30-150)
27        Sec. 30-150.  Police protection by  municipality;  county
28    under 1,000,000. In counties having a population of less than
29    1,000,000,  the  electors may authorize the township board to
30    contract with one or more incorporated  municipalities  lying

 1    wholly  or  partly  within the boundaries of the township, or
 2    with advice and consent of the sheriff in the county in which
 3    the request for contract  services  is  made,  based  upon  a
 4    determination  of  law enforcement needs of the area in which
 5    contract services are sought with the county within which the
 6    township is located to furnish police protection in the  area
 7    of  the  township that is not within the incorporated area of
 8    any municipality having a regular police department.

10        Section 15.  The Illinois Municipal Code  is  amended  by
11    changing Section 11-1-7 as follows:

13        Sec.   11-1-7.    The   corporate   authorities   of  any
14    incorporated municipality, the boundaries of  which  are  not
15    co-extensive  with  any  township, may contract with any such
16    township in the  county  within  which  the  municipality  is
17    located   to   furnish   police  protection  outside  of  the
18    incorporated municipality in such township.
19        The   corporate   authorities   of    any    incorporated
20    municipality  situated  in  a  county of fewer than 1,000,000
21    inhabitants may contract, with  advice  and  consent  of  the
22    sheriff  in  the  county  in  which  the request for contract
23    services  is  made,  based  upon  a  determination   of   law
24    enforcement  needs of the area in which contract services are
25    sought, with the county in which the municipality is  located
26    to  furnish  police  protection in the county  outside of the
27    incorporated municipality.

 1        Section 99.  Effective date.  This Act  takes  effect  on
 2    December 1, 1999.
