 1        AN  ACT  to  amend the Counties Code by changing Sections
 2    3-3009 and  3-3010.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  Counties  Code  is amended by changing
 6    Sections 3-3009 and 3-3010 as follows:

 7        (55 ILCS 5/3-3009) (from Ch. 34, par. 3-3009)
 8        Sec. 3-3009.   Deputy  coroner's,   sheriff's  or  police
 9    officer's  performance  of  coroner's  duties. If there is no
10    coroner, or it shall appear in like manner that he is also  a
11    party  to or interested in the suit, or of kin, or partial to
12    or prejudiced against  either  party,  process  may  in  like
13    manner issue to the deputy coroner designated by the coroner,
14    if  one is designated, or to any sheriff, sheriff's deputy or
15    police officer, in the county, who shall perform like  duties
16    as required of the coroner.

19        Sec. 3-3010.  Deputy sheriff, undersheriff, or coroner to
20    act  when  sheriff's  office  vacant. Where the office of the
21    sheriff is vacant, the chief deputy sheriff  or  undersheriff
22    designated  by  the  sheriff,  if  one  is designated, or the
23    coroner of the county shall perform all the  duties  required
24    by  law  to  be  performed  by the sheriff, and have the same
25    powers, and be liable to the same penalties  and  proceedings
26    as  if  he  were sheriff, until another sheriff is elected or
27    appointed and qualified.

29        Section 99.  Effective date.  This Act  takes  effect  on
