 1                     AMENDMENT TO HOUSE BILL 928

 2        AMENDMENT NO.     .  Amend House Bill 928, AS AMENDED, in
 3    Section 5 by replacing Sec. 5-5 with the following:

 4        "(35 ILCS 200/5-5)
 5        Sec. 5-5.  Election of commissioners of board of  review;
 6    counties of 3,000,000 or more.
 7        (a)  In  counties  with 3,000,000 or more inhabitants, on
 8    the first Tuesday after the first Monday in November 1994,  2
 9    commissioners  of  the  board of appeals  shall be elected to
10    hold office from the first Monday in December following their
11    election and until the first Monday in December 1998. In case
12    of any vacancy, the chief judge of the circuit court  or  any
13    judge  of  that  circuit  designated by the chief judge shall
14    fill the vacancy by appointment. The commissioners  shall  be
15    electors  in  the  particular  county  at  the  time of their
16    election or appointment and shall  hold  no  other  lucrative
17    public  office  or public employment. Each commissioner shall
18    receive compensation fixed by the county board,  which  shall
19    be  paid  out  of  the county treasury and which shall not be
20    changed during the term for which any commissioner is elected
21    or appointed. Effective the first Monday  in  December  1998,
22    the board of appeals is abolished.
23        The   board   of   appeals   shall   maintain  sufficient

 1    evidentiary records to support  all  decisions  made  by  the
 2    board  of  appeals.   All records, data, sales/ratio studies,
 3    and other information  necessary  for  the  board  of  review
 4    elected  under  subsection  (c)  to perform its functions and
 5    duties shall be transferred by the board of  appeals  to  the
 6    board of review on the first Monday in December 1998.
 7        (b) (Blank).
 8        (c)  In  each  county with 3,000,000 or more inhabitants,
 9    there is created a board of review. The board of review shall
10    consist of 3 commissioners members,  one  elected  from  each
11    election  district  in  the county at the general election in
12    1998 to hold office for a term beginning on the first  Monday
13    in   December   following  their  election  and  until  their
14    respective successors are elected and qualified.
15        No later than June 1, 1996, the  General  Assembly  shall
16    establish the boundaries for the 3 election districts in each
17    county  with  3,000,000  or  more  inhabitants.  The election
18    districts   shall   be   compact,   contiguous,   and    have
19    substantially  the  same population based on the 1990 federal
20    decennial census. One district shall  be  designated  as  the
21    first election district, one as the second election district,
22    and  one  as  the  third  election district. The commissioner
23    member from each district shall be elected to  a  term  of  4
24    years.
25        In  the year following each federal decennial census, the
26    General Assembly shall reapportion the election districts  to
27    reflect   the   results  of  the  census.  The  reapportioned
28    districts  shall  be   compact,   contiguous,   and   contain
29    substantially  the  same  population. The commissioner member
30    from the first district shall be elected to terms of 4 years,
31    4 years, and 2  years.  The   commissioner  member  from  the
32    second  district  shall  be  elected  to  terms of 4 years, 2
33    years, and 4 years. The commissioner member  from  the  third
34    district shall be elected to terms of 2 years, 4 years, and 4

 1    years.
 2        In  case of vacancy, the chief judge of the circuit court
 3    or any judge of the circuit court  designated  by  the  chief
 4    judge  shall fill the vacancy by appointment of a person from
 5    the same political party. If the vacancy is filled with  more
 6    than   28   months  remaining  in  the  term,  the  appointed
 7    commissioner  member  shall  serve  until  the  next  general
 8    election, at  which  time  a  commissioner  member  shall  be
 9    elected  to serve for the remainder of the term. If a vacancy
10    is filled with 28 months or less remaining in the  term,  the
11    appointment  shall  be  for  the  remainder  of the term. The
12    commissioners  members  shall  be   electors   within   their
13    respective election district at the time of their election or
14    appointment  and  shall hold no other lucrative public office
15    or public employment.
16        Each commissioner member shall receive compensation fixed
17    by the county board,  which shall be  paid  from  the  county
18    treasury.  Compensation for each commissioner member shall be
19    equitable and shall not be changed during the term for  which
20    that  commissioner member is elected or appointed. The county
21    shall provide suitable office space for the board of review.
22        For the year beginning on the first  Monday  in  December
23    1998  and ending the first Monday in December 1999, and every
24    fourth year thereafter, the chair of the board shall  be  the
25    commissioner member elected from the first district.  For the
26    year  beginning  the first Monday in December 1999 and ending
27    the first Monday in December  2000,  and  every  fourth  year
28    thereafter, the chair of the board shall be the commissioner
29    member  elected  from  the  second  district.   For  the year
30    beginning the first Monday in December 2000  and  ending  the
31    first   Monday  in  December  2001,  and  every  fourth  year
32    thereafter,  the  chair  shall  be  the  commissioner  member
33    elected from the third district.  For the year beginning  the
34    first  Monday in December 2001 and ending the first Monday in

 1    December 2002, and every fourth year thereafter, the chair of
 2    the board shall be determined by lot.
 3        On and after the first  Monday  in  December,  1998,  any
 4    reference  in  this Code to a board of appeals shall mean the
 5    board of  review  created  under  this  subsection,  and  any
 6    reference  to  a  member  of  a  board of review shall mean a
 7    commissioner of a  board  of  review.  The  board  of  review
 8    succeeds to the powers and duties of the board of appeals and
 9    has any powers and duties granted to it under this Code.  All
10    action  of the board of review shall be by a majority vote of
11    its commissioners members.
