      10 ILCS 5/25-11           from Ch. 46, par. 25-11
          Amends the Election Code.  Provides that when  a  vacancy
      occurs in any elective county office in a county which is not
      a  home  rule  unit,  the  county  central  committee  of the
      political party of which the incumbent was a candidate at the
      time of his or her election shall submit a list of 3 nominees
      to fill the vacancy to  the  chairman  of  the  county  board
      within   30  days  after  the  vacancy.   Provides  that  the
      appointee shall  be  one  of  the  3  nominees  on  the  list
      submitted  to  the  chairman of the county board, a member of
      the same political party as the person he or she succeds  was
      at the time of his or her election, and otherwise eligible to
      serve (now a member of the same political party and otherwise
      eligible to serve).

 1        AN  ACT  to  amend  the Election Code by changing Section
 2    25-11.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Election  Code  is amended by changing
 6    Section 25-11 as follows:

 8        Sec. 25-11.  County officers.  When a vacancy  occurs  in
 9    any  elective  county  office in a county which is not a home
10    rule unit, the county board shall declare that  such  vacancy
11    exists  and notification thereof shall be given to the county
12    central committee or the appropriate  county  board  district
13    committee  of  each established political party within 3 days
14    of  the  occurrence  of  the  vacancy.   The  county  central
15    committee of the political party of which the incumbent was a
16    candidate at the time of his or her election shall  submit  a
17    list of 3 nominees to fill the vacancy to the chairman of the
18    county  board  within  30  days  after  the occurrence of the
19    vacancy.  The vacancy shall  be  filled  within  60  days  by
20    appointment  of  the  chairman  of  the county board with the
21    advice and consent of the county board.  The appointee  shall
22    be  one  of  the  3  nominees  on  the  list submitted to the
23    chairman of the county board, a member of the same  political
24    party  as  the  person he or she  succeeds was at the time of
25    his or her election,  and  shall  be  otherwise  eligible  to
26    serve.  The  appointee  shall  serve  the  remainder  of  the
27    unexpired  term.   However,  if more than 28 months remain in
28    the term, the appointment shall be  until  the  next  general
29    election  at  which  time  the vacated county office shall be
30    filled by election for the remainder of  the  term.   In  the
31    case  of a vacancy in a seat on a county board which has been

 1    divided  into  districts  under  "An  Act  relating  to   the
 2    composition  of  an  election  of  county  boards  in certain
 3    counties",  approved  October  2,  1969,  as   amended,   the
 4    appointee  must  also  be  a  resident  of  the  county board
 5    district.
 6        Except as otherwise provided by county  ordinance  or  by
 7    law,  in  any  county which is a home rule unit, vacancies in
 8    elective county offices,  other  than  the  office  of  chief
 9    executive officer, shall be filled by the county board.
