 1                    AMENDMENT TO HOUSE BILL 1641
 2        AMENDMENT NO.     .  Amend House Bill 1641 on page 1,  by
 3    replacing lines 1 and 2 with the following:
 4        "AN ACT concerning local governments."; and
 5    on page 1, below line 4, by inserting the following:
 6        "Section  3.   The  Counties  Code is amended by changing
 7    Sections 3-7002, 3-7005, and 3-15012 as follows:
 8        (55 ILCS 5/3-7002) (from Ch. 34, par. 3-7002)
 9        Sec. 3-7002.  Cook County Sheriff's Merit Board. There is
10    created the Cook County Sheriff's  Merit  Board,  hereinafter
11    called  the  Board,  consisting of 5 members appointed by the
12    Sheriff with the advice and  consent  of  the  county  board,
13    except   that  on  and  after  the  effective  date  of  this
14    amendatory  Act  of  1997,  the  Sheriff  may   appoint   two
15    additional members, with the advice and consent of the county
16    board,  at  his  or  her  discretion.   Of  the members first
17    appointed, one shall serve until the third Monday  in  March,
18    1965 one until the third Monday in March, 1967, and one until
19    the  third Monday in March, 1969. Of the 2 additional members
20    first appointed under authority of  this  amendatory  Act  of
21    1991,  one shall serve until the third Monday in March, 1995,

 1    and one until the third Monday in March, 1997.
 2        Upon the expiration of the terms of office of those first
 3    appointed (including the 2 additional members first appointed
 4    under authority  of  this  amendatory  Act  of  1991),  their
 5    respective  successors shall be appointed to hold office from
 6    the third Monday in March of the  year  of  their  respective
 7    appointments for a term of 6 years and until their successors
 8    are  appointed  and qualified for a like term.  As additional
 9    members are appointed under authority of this amendatory  Act
10    of   1997,   their   terms  shall  be  set  to  be  staggered
11    consistently with the terms of the existing Board members. No
12    more than 3 members of the Board shall be affiliated with the
13    same political party, except that as additional  members  are
14    appointed  by  the sheriff under authority of this amendatory
15    Act of 1997, the political affiliation of the Board shall  be
16    such  that  no  more  than  one-half  of the members plus one
17    additional member may be affiliated with the  same  political
18    party.   No  ,  nor  shall any member shall have held or have
19    been a candidate for an elective  public  office  within  one
20    year preceding his or her appointment.
21        The Sheriff may deputize members of the Board.

24        Sec.  3-7005.  Meetings. As soon as practicable after the
25    members of the Board have been appointed,  they  shall  meet,
26    upon the call of the Sheriff, and shall organize by selecting
27    a   chairman  and  a  secretary.  The  initial  chairman  and
28    secretary, and their successors, shall  be  selected  by  the
29    Board from among its members for a term of 2 years or for the
30    remainder  of  their term of office as a member of the Board,
31    whichever is the shorter. Two  members  of  the  Board  shall
32    constitute  a  quorum for the transaction of business, except
33    that as additional members are appointed under  authority  of

 1    this  amendatory Act of 1997, the number of members that must
 2    be present to constitute a quorum  shall  be  the  number  of
 3    members that constitute at least 40% of the Board.  The Board
 4    shall hold regular quarterly meetings and such other meetings
 5    as may be called by the chairman.

 8        Sec.  3-15012.  Executive  Director.  The  Sheriff  shall
 9    appoint  a  an  Executive  Director  to   act  as  the  chief
10    executive  and  administrative officer of the Department. The
11    Executive Director shall be appointed by the Sheriff  from  a
12    list  of  3 persons nominated by the members of the Board. He
13    or she shall serve at the pleasure of  the  Sheriff.  If  the
14    Executive  Director  is  removed,  the Board shall nominate 3
15    persons, one of whom shall be  selected  by  the  Sheriff  to
16    serve   as   Executive  Director.  The  Executive  Director's
17    compensation is determined by the County Board.

19    on page 1, below line 20, by inserting the following:
20        "Section 99.  Effective date.  This Act takes effect upon
21    becoming law.".
