Amends the Illinois Clean Indoor Air Act. Provides that
no person shall smoke in a hospital, ambulatory surgical
treatment center, post-surgical recovery center, nursing
home, dentist's or physicians's office, or any other health
care provider or facility.

1 AN ACT to amend the Illinois Clean Indoor Air Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Clean Indoor Air Act is amended
5 by changing Section 4 as follows:
6 (410 ILCS 80/4) (from Ch. 111 1/2, par. 8204)
7 Sec. 4. Smoking in public places; exceptions. No person
8 shall smoke in a hospital, ambulatory surgical treatment
9 center, post-surgical recovery center, dentist's or
10 physician's office, or any other health care provider or
11 facility, except that a resident may smoke in a facility
12 licensed under the Nursing Home Care Act. No person shall
13 smoke in any other a public place except in that portion of a
14 public place which may be established and posted under
15 Section 5 as a smoking area. This prohibition does not apply
16 in cases in which an entire room or hall is used for a
17 private social function and seating arrangements are under
18 the control of the sponsor of the function and not of the
19 proprietor or person in charge of the place. Furthermore,
20 this prohibition shall not apply to factories, warehouses and
21 similar places of work not usually frequented by the general
22 public.
