AMENDMENT TO SENATE BILL 2031

2    AMENDMENT NO. ______. Amend Senate Bill 2031, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Public Aid Code is amended by
6changing Section 11-4.1 as follows:
 
7    (305 ILCS 5/11-4.1)
8    Sec. 11-4.1. Medical providers assisting with applications
9for medical assistance. A provider enrolled to provide medical
10assistance services may, upon the request of an applicant
11individual, accompany, represent, and assist the applicant
12individual in applying for medical assistance under Article V
13of this Code, including the pursuit of any appeals related to
14the application, on behalf of the applicant during the
15applicant's life and after the applicant's death. If an
16applicant individual is unable to request such assistance due

1to incapacity or mental incompetence and has no other
2representative willing or able to assist in the application
3process, a facility licensed under the Nursing Home Care Act,
4the ID/DD Community Care Act, or the MC/DD Act or certified
5under this Code is authorized to assist the applicant
6individual in applying for long-term care services, including
7the pursuit of any appeals related to the application, on
8behalf of the applicant during the applicant's life and after
9the applicant's death. Subject to the provisions of the Free
10Healthcare Benefits Application Assistance Act, nothing in
11this Section shall be construed as prohibiting any individual
12or entity from assisting another individual in applying for
13medical assistance under Article V of this Code.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
