AMENDMENT TO SENATE BILL 633

2    AMENDMENT NO. ______. Amend Senate Bill 633 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Downstate Public Transportation Act is
5amended by changing Section 2-15.2 as follows:
 
6    (30 ILCS 740/2-15.2)
7    Sec. 2-15.2. Free and reduced services; eligibility.
8    (a) Notwithstanding any law to the contrary, no later than
960 days following the effective date of this amendatory Act of
10the 95th General Assembly and until subsection (b) is
11implemented, any fixed route public transportation services
12provided by, or under grant or purchase of service contracts
13of, every participant, as defined in Section 2-2.02 (1)(a),
14shall be provided without charge to all senior citizen
15residents of the participant aged 65 and older, under such
16conditions as shall be prescribed by the participant.

1    (b) Notwithstanding any law to the contrary, no later than
2180 days following the effective date of this amendatory Act of
3the 96th General Assembly, any fixed route public
4transportation services provided by, or under grant or purchase
5of service contracts of, every participant, as defined in
6Section 2-2.02 (1)(a), shall be provided without charge to
7senior citizens aged 65 and older who meet the income
8eligibility limitation set forth in subsection (a-5) of Section
94 of the Senior Citizens and Persons with Disabilities Property
10Tax Relief Act, under such conditions as shall be prescribed by
11the participant. The Department on Aging shall furnish all
12information reasonably necessary to determine eligibility,
13including updated lists of individuals who are eligible for
14services without charge under this Section. Nothing in this
15Section shall relieve the participant from providing reduced
16fares as may be required by federal law.
17    (c) Notwithstanding any law to the contrary, no later than
18180 days following the effective date of this amendatory Act of
19the 100th General Assembly, any fixed route public
20transportation services provided by, or under grant or purchase
21of service contracts of, a participant shall be provided (i)
22without charge to a veteran that has a combined disability
23rating of more than 70% as certified by the U.S. Department of
24Veterans Affairs, and (ii) at a 50% reduced fare for a veteran
25who has a combined disability rating of 30% to 70% as certified
26by the U.S. Department of Veterans Affairs, under conditions

1prescribed by each participant.
2    (d) Notwithstanding any law to the contrary, on and after
3January 1, 2018, any fixed route public transportation services
4provided by, or under grant or purchase of service contracts
5of, a participant shall be provided without charge to high
6school students that are eligible for free or reduced price
7meals and free milk under the federal National School Lunch
8Program or the Commodity School Program on days when school is
9in session.
10    (e) On the first December 31st after the effective date of
11this amendatory Act of the 100th General Assembly and on
12December 31st of each year thereafter, each participant shall
13certify to the State Comptroller the annual amount necessary
14for payment of expenses related to subsections (c) and (d).
15Beginning in State fiscal year 2018, there is hereby
16appropriated, on an irrevocable and continuing annual basis,
17from the Road Fund amounts equal to the amount certified each
18year by each participant for payment of expenses related to
19subsections (c) and (d). The moneys appropriated under this
20subsection (e) shall be paid to each participant in an amount
21equal to the participant's certification for payment of
22expenses related to subsections (c) and (d).

24    Section 10. The Metropolitan Transit Authority Act is
25amended by changing Section 51 as follows:

2    Sec. 51. Free and reduced services; eligibility.
3    (a) Notwithstanding any law to the contrary, no later than
460 days following the effective date of this amendatory Act of
5the 95th General Assembly and until subsection (b) is
6implemented, any fixed route public transportation services
7provided by, or under grant or purchase of service contracts
8of, the Board shall be provided without charge to all senior
9citizens of the Metropolitan Region (as such term is defined in
1070 ILCS 3615/1.03) aged 65 and older, under such conditions as
11shall be prescribed by the Board.
12    (b) Notwithstanding any law to the contrary, no later than
13180 days following the effective date of this amendatory Act of
14the 96th General Assembly, any fixed route public
15transportation services provided by, or under grant or purchase
16of service contracts of, the Board shall be provided without
17charge to senior citizens aged 65 and older who meet the income
18eligibility limitation set forth in subsection (a-5) of Section
194 of the Senior Citizens and Persons with Disabilities Property
20Tax Relief Act, under such conditions as shall be prescribed by
21the Board. The Department on Aging shall furnish all
22information reasonably necessary to determine eligibility,
23including updated lists of individuals who are eligible for
24services without charge under this Section. Nothing in this

3180 days following the effective date of this amendatory Act of

8    Section 15. The Local Mass Transit District Act is amended
9by changing Section 8.6 as follows:

11    Sec. 8.6. Free and reduced services; eligibility.
12    (a) Notwithstanding any law to the contrary, no later than
1360 days following the effective date of this amendatory Act of
14the 95th General Assembly and until subsection (b) is
15implemented, any fixed route public transportation services
16provided by, or under grant or purchase of service contracts
17of, every District shall be provided without charge to all
18senior citizens of the District aged 65 and older, under such
19conditions as shall be prescribed by the District.
20    (b) Notwithstanding any law to the contrary, no later than
21180 days following the effective date of this amendatory Act of
22the 96th General Assembly, any fixed route public
23transportation services provided by, or under grant or purchase
24of service contracts of, every District shall be provided

8Beginning in State fiscal year 2018, there is hereby
9appropriated, on an irrevocable and continuing annual basis,
10from the Road Fund amounts equal to the amount certified each
11year by each District for payment of expenses related to
12subsections (c) and (d). The moneys appropriated under this
13subsection (e) shall be paid to each District in an amount
14equal to the District's certification for payment of expenses
15related to subsections (c) and (d).

17    Section 20. The Regional Transportation Authority Act is
18amended by changing Sections 3A.15 and 3B.14 as follows:

21    (a) Notwithstanding any law to the contrary, no later than
2260 days following the effective date of this amendatory Act of
23the 95th General Assembly and until subsection (b) is
24implemented, any fixed route public transportation services

1provided by, or under grant or purchase of service contracts
2of, the Suburban Bus Board shall be provided without charge to
3all senior citizens of the Metropolitan Region aged 65 and
4older, under such conditions as shall be prescribed by the
5Suburban Bus Board.
6    (b) Notwithstanding any law to the contrary, no later than
7180 days following the effective date of this amendatory Act of
8the 96th General Assembly, any fixed route public
9transportation services provided by, or under grant or purchase
10of service contracts of, the Suburban Bus Board shall be
11provided without charge to senior citizens aged 65 and older
12who meet the income eligibility limitation set forth in
13subsection (a-5) of Section 4 of the Senior Citizens and
14Persons with Disabilities Property Tax Relief Act, under such
15conditions as shall be prescribed by the Suburban Bus Board.
16The Department on Aging shall furnish all information
17reasonably necessary to determine eligibility, including
18updated lists of individuals who are eligible for services
19without charge under this Section. Nothing in this Section
20shall relieve the Suburban Bus Board from providing reduced
21fares as may be required by federal law.
22    (c) Notwithstanding any law to the contrary, no later than
23180 days following the effective date of this amendatory Act of
24the 100th General Assembly, any fixed route public
25transportation services provided by, or under grant or purchase
26of service contracts of, the Suburban Bus Board shall be

1provided (i) without charge to a veteran that has a combined
2disability rating of more than 70% as certified by the U.S.
3Department of Veterans Affairs, and (ii) at a 50% reduced fare
4for a veteran who has a combined disability rating of 30% to
570% as certified by the U.S. Department of Veterans Affairs,
6under conditions prescribed by the Suburban Bus Board.
7    (d) Notwithstanding any law to the contrary, on and after
8January 1, 2018, any fixed route public transportation services
9provided by, or under grant or purchase of service contracts
10of, the Suburban Bus Board shall be provided without charge to
11high school students that are eligible for free or reduced
12price meals and free milk under the federal National School
13Lunch Program or the Commodity School Program on days when
14school is in session.
15    (e) On the first December 31st after the effective date of
16this amendatory Act of the 100th General Assembly and on
17December 31st of each year thereafter, the Suburban Bus Board
18shall certify to the State Comptroller the annual amount
19necessary for payment of expenses related to subsections (c)
20and (d). Beginning in State fiscal year 2018, there is hereby
21appropriated, on an irrevocable and continuing annual basis,
22from the Road Fund an amount equal to the amount certified each
23year by the Suburban Bus Board for payment of expenses related
24to subsections (c) and (d). The moneys appropriated under this
25subsection (e) shall be paid to the Suburban Bus Board in an
26amount equal to the Suburban Bus Board's certification for

10of, the Commuter Rail Board shall be provided without charge to
11all senior citizens of the Metropolitan Region aged 65 and
12older, under such conditions as shall be prescribed by the
13Commuter Rail Board.
14    (b) Notwithstanding any law to the contrary, no later than
15180 days following the effective date of this amendatory Act of
16the 96th General Assembly, any fixed route public
17transportation services provided by, or under grant or purchase
18of service contracts of, the Commuter Rail Board shall be
19provided without charge to senior citizens aged 65 and older
20who meet the income eligibility limitation set forth in
21subsection (a-5) of Section 4 of the Senior Citizens and
22Persons with Disabilities Property Tax Relief Act, under such
23conditions as shall be prescribed by the Commuter Rail Board.

1470% as certified by the U.S. Department of Veterans Affairs,
15under conditions prescribed by the Commuter Rail Board.
16    (d) Notwithstanding any law to the contrary, on and after
