AMENDMENT TO SENATE BILL 313

2    AMENDMENT NO. ______. Amend Senate Bill 313 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Food, Drug and Cosmetic Act is
5amended by adding Section 21.4 as follows:
 
6    (410 ILCS 620/21.4 new)
7    Sec. 21.4. Restaurants; transglutaminase.
8    (a) As used in this Section:
9    "Restaurant" means any business that is primarily engaged
10in the sale of ready-to-eat food for immediate consumption.
11"Primarily engaged" means having sales of ready-to-eat food for
12immediate consumption comprising at least 51% of the total
13sales, excluding the sale of liquor.
14    "Transglutaminase" means an enzyme derived from
15Streptoverticillium mobaraense that is approved for use as a
16binder to form smaller cuts of meat into a larger serving of

1meat.
2    (b) A restaurant must disclose if an item on the
3restaurant's menu uses transglutaminase to form smaller cuts of
4meat into a larger serving of meat by (1) including the term
5"formed" in the item's name on the menu, and (2) by denoting on
6the menu that the item is "made with transglutaminase".
7    Meat products or poultry products produced in accordance
8with the Federal Meat Inspection Act (21 U.S.C. 601), the
9federal Poultry Products Inspection Act (21 U.S.C. 451), or the
10Meat and Poultry Inspection Act are exempt from the provisions
11of this Section.
12    (c) The Department of Public Health may adopt any rules
13necessary to implement this Section.".
