Amends the Illinois Vehicle Code. Provides that an interstate carrier operating intrastate may operate a motor vehicle upon the public roads of this State without the authority number of the carrier painted or affixed to any side of the cab or power unit. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Section 18c-4701 as follows:
| 6 | | (625 ILCS 5/18c-4701) (from Ch. 95 1/2, par. 18c-4701)
| 7 | | Sec. 18c-4701. Insignia on Vehicles.
| 8 | | (1) General Requirements to be Prescribed by Commission. | 9 | | Except as
otherwise provided in this Section, no intrastate
| 10 | | carrier shall operate any motor vehicle upon the
public roads | 11 | | of this State unless there is painted or affixed to
both sides | 12 | | of the cab or power unit, in accordance with such | 13 | | specifications as
the Commission may prescribe, the trade name | 14 | | of the carrier as it
appears on the carrier's license or the | 15 | | carrier's recognized
logo, together with the license and | 16 | | registration number of the
carrier. Likewise, no interstate | 17 | | carrier shall operate any motor
vehicle upon the public roads | 18 | | of this State unless there is
painted or affixed to both sides | 19 | | of the cab or power unit, in accordance with
such | 20 | | specifications as the Commission may prescribe, the
| 21 | | registration or authority number of the carrier. However, an | 22 | | interstate carrier operating intrastate may operate a motor | 23 | | vehicle upon the public roads of this State without the |

| 1 | | authority number of the carrier painted or affixed to any side | 2 | | of the cab or power unit.
| 3 | | (2) Use of ICC-Prescribed Identification. Identifying | 4 | | information
prescribed by the Interstate Commerce Commission | 5 | | may be used in
satisfaction of requirements established under | 6 | | this Section, including
special orders granting a petition for | 7 | | waiver of Sections 1057.22(a) and
1057.22(c)(2) and (4), as | 8 | | they relate to equipment receipts, of the Lease
and Interchange | 9 | | of Vehicle Regulations (49 CFR 1057), in lieu of
numbers or | 10 | | symbols prescribed by the Commission.
| 11 | | (3) Identification of Trip Lessees. Notwithstanding any | 12 | | other
provision of this Section to the contrary, a motor | 13 | | vehicle trip leased in
accordance with this Chapter, Commission | 14 | | regulations and orders shall not
be required to bear the name | 15 | | and license number of the lessee if:
| 16 | | (a) the motor vehicle bears the name and license or | 17 | | registration number
of the lessor in accordance with | 18 | | subsection (1) of this Section, Commission
regulations and | 19 | | orders;
| 20 | | (b) the lessor and lessee are commonly-owned; and
| 21 | | (c) the vehicle carries a photocopy of a letter signed | 22 | | by the lessor, on
file with the Commission, stating that | 23 | | the lessor and lessee are
commonly-owned.
| 24 | | (4) Rules not superseded. The authority of the Illinois | 25 | | Commerce
Commission to regulate the identification of motor | 26 | | vehicles of intrastate
and interstate carriers, engaged in the |

| 1 | | transportation of hazardous
materials, shall not supersede or | 2 | | replace the rules and regulations of the
Illinois Department of | 3 | | Transportation and Federal Motor Carrier Safety
regulations | 4 | | Part 390.21, as relates now or hereafter to the markings and
| 5 | | identification of such vehicles.
| 6 | | (5) Identification on vehicles under 9,000 pounds gross | 7 | | vehicle weight
(GVW). Vehicles with a gross vehicle weight | 8 | | (GVW) less than 9,000 pounds
may, in lieu of identification | 9 | | required under subsection (1) of this
Section display the trade | 10 | | name of the carrier as it appears on the
carrier's license or | 11 | | the carrier's recognized logo, together with the
license and | 12 | | registration number of the carrier in such manner as to be
| 13 | | clearly legible and visible from both sides of the vehicle at a | 14 | | distance of
25 feet, when the vehicle is not in motion, and in | 15 | | accordance with such
specifications as the Commission may | 16 | | prescribe.
