AMENDMENT TO SENATE BILL 3106

2    AMENDMENT NO. ______. Amend Senate Bill 3106 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Local Records Act is amended by adding
5Section 20 as follows:
 
6    (50 ILCS 205/20 new)
7    Sec. 20. Internet posting requirements.
8    (a) A unit of local government or a school district that
9serves a population of less than 3,000,000 and that maintains
10an Internet website shall, within 90 days of the effective date
11of this amendatory Act of the 98th General Assembly, do each of
12the following:
13        (1) maintain an electronic mail system;
14        (2) maintain and provide an electronic mail address for
15    each of its officials in the course of their official
16    duties to be used exclusively for correspondence directly

1    related to the official business of that unit of local
2    government or school district; and
3        (3) post to its website for the current calendar year
4    the contact information, including an electronic mail
5    address, for all elected and appointed officials.
6    (b) The information required to be posted under this
7Section must be easily accessible from the unit of local
8government's or school district's home page and searchable.
9    (c) The postings required by this Section are in addition
10to any other posting requirements required by law or ordinance.
11    (d) No home rule unit may adopt posting requirements that
12are less restrictive than this Section. This Section is a
13limitation under subsection (i) of Section 6 of Article VII of
14the Illinois Constitution on the concurrent exercise by home
15rule units of powers and functions exercised by the State.
 
16    Section 90. The State Mandates Act is amended by adding
17Section 8.38 as follows:
 
18    (30 ILCS 805/8.38 new)
19    Sec. 8.38. Exempt mandate. Notwithstanding Sections 6 and 8
20of this Act, no reimbursement by the State is required for the
21implementation of any mandate created by this amendatory Act of
22the 98th General Assembly.".
