    Amends the Illinois Governmental Ethics Act. Creates a uniform statement of economic interest form that must be completed by all persons who are required to file that form under the Act. Changes the nature of the required disclosures that must be made. Authorizes the Secretary of State to institute an electronic statement of economic interest filing system. Repeals a provision that established a separate form for persons required to file a statement of economic interests with county clerks. Effective January 1, 2014.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Governmental Ethics Act is amended
5by changing Sections 1-105, 1-110, 4A-102, 4A-103, and 4A-108
6and by adding Sections 1-102.5, 1-104.3, 1-104.4, 1-104.5,
71-105.2, 1-105.3, 1-105.4, 1-105.5, 1-105.6, 1-105.7, 1-112.5,
8and 1-113.6 as follows:
 
9    (5 ILCS 420/1-102.5 new)
10    Sec. 1-102.5. "Asset" means, for the purposes of Sections
114A-102 and 4A-103, an item that is owned and has monetary
12value. For the purposes of Sections 4A-102 and 4A-103, assets
13include, but are not limited to: stocks, bonds (except those
14issued by the federal, state, or local governments), sector
15mutual funds, sector exchange traded funds, commodity futures,
16investment real estate, and partnership interests. For the
17purposes of Sections 4A-102 and 4A-103, assets do not include:
18personal residences; personal vehicles; savings or checking
19accounts; bonds, notes, or securities issued by any branch of
20federal, state, or local government; Medicare benefits;
21inheritances or bequests; diversified mutual funds; annuities;
22pensions (including government pensions); retirement accounts;
23college savings plans that are qualified tuition plans; or

1non-income producing trust holdings.
 
2    (5 ILCS 420/1-104.3 new)
3    Sec. 1-104.3. "Creditor" means, for the purposes of
4Sections 4A-102 and 4A-103, an individual, organization, or
5other business entity to whom money or its equivalent is owed,
6no matter whether that obligation is secured or unsecured,
7except that if a filer makes a loan to members of his or her
8family, a political committee registered with the Illinois
9State Board of Elections, or a political committee, principal
10campaign committee, or authorized committee registered with
11the Federal Election Commission, then that filer does not, by
12making such a loan, become a creditor of that individual or
13entity for the purposes of Sections 4A-102 and 4A-103 of this
14Act.
 
15    (5 ILCS 420/1-104.4 new)
16    Sec. 1-104.4. "Debt" means, for the purposes of Sections
174A-102 and 4A-103, any money or monetary obligation owed at any
18time during the preceding calendar year to an individual,
19company, or other organization, other than a loan that is from
20a financial institution, government agency, or business entity
21and that is granted on terms made available to the general
22public. For the purposes of Sections 4A-102 and 4A-103, "debt"
23includes, but is not limited to: personal loans from friends or
24business associates, business loans made outside the lender's

1regular course of business, and loans made at below market
2rates. For the purposes of Sections 4A-102 and 4A-103, "debt"
3does not include: (i) debts to or from financial institutions
4or government entities, such as mortgages, student loans,
5credit card debts, or loans secured by automobiles, household
6furniture, or appliances, as long as those loans were made on
7terms available to the general public and do not exceed the
8purchase price of the items securing them; or (ii) debts to or
9from political committees registered with the Illinois State
10Board of Elections or political committees, principal campaign
11committees, or authorized committees registered with the
12Federal Election Commission.
 
13    (5 ILCS 420/1-104.5 new)
14    Sec. 1-104.5. "Diversified funds" means investment
15products, such as mutual funds, exchange traded funds, or unit
16investment trusts, that invest in a wide variety of securities.
 
17    (5 ILCS 420/1-105)  (from Ch. 127, par. 601-105)
18    Sec. 1-105. "Economic opportunity" means any purchase,
19sale, lease, contract, option, or other transaction or
20arrangement involving property or services wherein a
21legislator or, in the case of Sections 4A-102 and 4A-103, the
22filer may gain an economic benefit. The term shall not include
23gifts.

1    (5 ILCS 420/1-105.2 new)
2    Sec. 1-105.2. "Economic relationship" means, for the
3purposes of Sections 4A-102 and 4A-103, any relationship that
4provides the filer with income or an economic opportunity. For
5the purposes of Sections 4A-102 and 4A-103, economic
6relationships include, but are not limited to, ownership
7interests in family-owned businesses and creditor-debtor
8relationships with third parties other than commercial lending
9institutions.
 
10    (5 ILCS 420/1-105.3 new)
11    Sec. 1-105.3. "Family" means, for the purposes of Sections
124A-102 and 4A-103, a filer's spouse (including a party to a
13civil union or a registered domestic partner), children,
14step-children, parents, step-parents, siblings, step-siblings,
15half-siblings, parents-in-law, brothers-in-law,
16sisters-in-law, sons-in-law, daughters-in-law, aunts, uncles,
17nieces, nephews, great aunts, great uncles, first cousins,
18grandfathers, grandmothers, grandsons, and granddaughters, as
19well as the father, mother, grandfather, and grandmother of the
20filer's spouse.
 
21    (5 ILCS 420/1-105.4 new)
22    Sec. 1-105.4. "Filer" means, for the purposes of Section
234A-102 and 4A-103, a person required to file a statement of

1economic interests pursuant to this Act.
 
2    (5 ILCS 420/1-105.5 new)
3    Sec. 1-105.5. "Gift" has the meaning ascribed to that term
4in Section 1-5 of the State Officials and Employees Ethics Act
5but does not include any item or benefit to which an exception
6in Section 10-15 of that Act applies.
 
7    (5 ILCS 420/1-105.6 new)
8    Sec. 1-105.6. "Income" means, for the purposes of Sections
94A-102 and 4A-103, income from whatever source derived,
10including, but not limited to: compensation received for
11services rendered or to be rendered (as reported on any
12Internal Revenue Service forms, including, but not limited to,
13W-2 and 1099); earnings or capital gains from the sale of goods
14or property; profit from financial investments or other assets;
15dividends from common stock; interest or dividend income from
16all assets; revenue from leases and rentals, royalties, prizes,
17awards, or barter; forgiveness of debt; and earnings derived
18from pensions, retirement accounts, annuities or trusts other
19than testamentary trusts. "Income" does not include
20compensation earned for service in the position that
21necessitates the filing of the statement of economic interests,
22and income from the sale of a personal residence or personal
23vehicles.

2    Sec. 1-105.7. "Investment real estate" means any real
3property, other than a filer's personal residences, purchased
4to produce a profit, whether from income or resale.

6    Sec. 1-110. "Lobbyist" means an individual who is required
7to be registered to engage in lobbying activities pursuant to
8any statute, regulation, or ordinance adopted by a unit of
9government in the State of Illinois any person required to be
10registered under "An Act concerning lobbying and providing a
11penalty for violation thereof", approved July 10, 1957, as
12amended.

14    (5 ILCS 420/1-112.5 new)
15    Sec. 1-112.5. "Personal residence" means, for the purposes
16of Sections 4A-102 and 4A-103, a filer's primary home residence
17and any residential real property held by the filer and used by
18the filer for residential rather than commercial or income
19generating purposes.
 
20    (5 ILCS 420/1-113.6 new)
21    Sec. 1-113.6. "Sector funds" means mutual funds or exchange
22traded funds invested in a particular industry or business.

1    (5 ILCS 420/4A-102)  (from Ch. 127, par. 604A-102)
2    Sec. 4A-102. The statement of economic interests required
3by this Article shall include the economic interests of the
4person making the statement as provided in this Section. The
5following interests shall be listed by all persons required to
6file: The interest (if constructively controlled by the person
7making the statement) of a spouse or any other party, shall be
8considered to be the same as the interest of the person making
9the statement. Campaign receipts shall not be included in this
10statement.
11        (1) each asset that has a value of more than $10,000 as
12    of the end of the preceding calendar year and is: (i) held
13    in the filer's name; (ii) held jointly by the filer with
14    his or her spouse (including a party to a civil union or a
15    registered domestic partner), his or her minor child or
16    children, or his or her spouse and minor child or children;
17    or (iii) held by the filer's minor child or children;
18        (2) excluding the income from the position that
19    requires the filing of a statement of economic interests
20    under this Act, each source of income that generated in
21    excess of $2,500 during the preceding calendar year (as
22    reported on the filer's federal income tax return covering
23    the preceding calendar year) and, if the sale or transfer
24    of an asset produced more than $2,500 in income during the
25    preceding calendar year, the transaction date on which that
26    asset was sold or transferred;

1        (3) each creditor of a debt in excess of $5,000 that,
2    during the preceding calendar year, was: (i) owed by the
3    filer; (ii) owed jointly by the filer with his or her
4    spouse (including a party to a civil union or registered
5    domestic partner), his or her minor child or children, or
6    his or her spouse and minor child or children; or (iii)
7    owed by the filer's minor child or children;
8        (4) each debtor of a debt in excess of $5,000 that,
9    during the preceding calendar year, was: (i) owed to the
10    filer; (ii) owed jointly to the filer and his or her spouse
11    (including a party to a civil union or a registered
12    domestic partner), his or her minor child or children, or
13    his or her spouse and minor child or children; or (iii)
14    owed to the filer's minor child or children;
15        (5) each lobbyist registered with any unit of
16    government in the State of Illinois and with whom the filer
17    maintains an economic relationship, or each lobbyist
18    registered with any unit of government in the State of
19    Illinois who is the spouse (including a party to a civil
20    union or a registered domestic partner), child,
21    step-child, parent, step-parent, or sibling of the filer;
22    and
23        (6) each source and type of gift having a value of $500
24    or more, or an aggregate value of $500 or more, for gifts
25    from a single source, received by the filer during the
26    preceding calendar year, excluding gifts received from any

1    family member or from an individual given on the basis of
2    personal friendship.
3        (a) The following interests shall be listed by all
4    persons required to file:
5            (1) The name, address and type of practice of any
6        professional organization or individual professional
7        practice in which the person making the statement was
8        an officer, director, associate, partner or
9        proprietor, or served in any advisory capacity, from
10        which income in excess of $1200 was derived during the
11        preceding calendar year;
12            (2) The nature of professional services (other
13        than services rendered to the unit or units of
14        government in relation to which the person is required
15        to file) and the nature of the entity to which they
16        were rendered if fees exceeding $5,000 were received
17        during the preceding calendar year from the entity for
18        professional services rendered by the person making
19        the statement.
20            (3) The identity (including the address or legal
21        description of real estate) of any capital asset from
22        which a capital gain of $5,000 or more was realized in
23        the preceding calendar year.
24            (4) The name of any unit of government which has
25        employed the person making the statement during the
26        preceding calendar year other than the unit or units of

1        government in relation to which the person is required
2        to file.
3            (5) The name of any entity from which a gift or
4        gifts, or honorarium or honoraria, valued singly or in
5        the aggregate in excess of $500, was received during
6        the preceding calendar year.
7        (b) The following interests shall also be listed by
8    persons listed in items (a) through (f), item (l), item
9    (n), and item (p) of Section 4A-101:
10            (1) The name and instrument of ownership in any
11        entity doing business in the State of Illinois, in
12        which an ownership interest held by the person at the
13        date of filing is in excess of $5,000 fair market value
14        or from which dividends of in excess of $1,200 were
15        derived during the preceding calendar year. (In the
16        case of real estate, location thereof shall be listed
17        by street address, or if none, then by legal
18        description). No time or demand deposit in a financial
19        institution, nor any debt instrument need be listed;
20            (2) Except for professional service entities, the
21        name of any entity and any position held therein from
22        which income of in excess of $1,200 was derived during
23        the preceding calendar year, if the entity does
24        business in the State of Illinois. No time or demand
25        deposit in a financial institution, nor any debt
26        instrument need be listed.

1            (3) The identity of any compensated lobbyist with
2        whom the person making the statement maintains a close
3        economic association, including the name of the
4        lobbyist and specifying the legislative matter or
5        matters which are the object of the lobbying activity,
6        and describing the general type of economic activity of
7        the client or principal on whose behalf that person is
8        lobbying.
9        (c) The following interests shall also be listed by
10    persons listed in items (g), (h), (i), and (o) of Section
11    4A-101:
12            (1) The name and instrument of ownership in any
13        entity doing business with a unit of local government
14        in relation to which the person is required to file if
15        the ownership interest of the person filing is greater
16        than $5,000 fair market value as of the date of filing
17        or if dividends in excess of $1,200 were received from
18        the entity during the preceding calendar year. (In the
19        case of real estate, location thereof shall be listed
20        by street address, or if none, then by legal
21        description). No time or demand deposit in a financial
22        institution, nor any debt instrument need be listed.
23            (2) Except for professional service entities, the
24        name of any entity and any position held therein from
25        which income in excess of $1,200 was derived during the
26        preceding calendar year if the entity does business

1        with a unit of local government in relation to which
2        the person is required to file. No time or demand
3        deposit in a financial institution, nor any debt
4        instrument need be listed.
5            (3) The name of any entity and the nature of the
6        governmental action requested by any entity which has
7        applied to a unit of local government in relation to
8        which the person must file for any license, franchise
9        or permit for annexation, zoning or rezoning of real
10        estate during the preceding calendar year if the
11        ownership interest of the person filing is in excess of
12        $5,000 fair market value at the time of filing or if
13        income or dividends in excess of $1,200 were received
14        by the person filing from the entity during the
15        preceding calendar year.
16    For the purposes of this Section, the unit of local
17government in relation to which a person required to file under
18item (o) of Section 4A-101 shall be the unit of local
19government that contributes to the pension fund of which such
20person is a member of the board.

2making the statement and shall contain substantially the

5INSTRUCTIONS:
6    You may find the following documents helpful to you in
7completing this form:
8        (1) federal income tax returns, including any related
9    schedules, attachments, and forms; and
10        (2) investment and brokerage statements.
11    To complete this form, you do not need to disclose specific
12amounts or values or report interests relating either to
13political committees registered with the Illinois State Board
14of Elections or to political committees, principal campaign
15committees, or authorized committees registered with the
16Federal Election Commission.
17    The information you disclose will be available to the
18public.
19    You must answer all 6 questions. Certain questions will ask
20you to report any applicable assets or debts held in your name;
21held jointly with your spouse (including a party to a civil
22union or a registered domestic partner), your minor child, or
23both your spouse and minor child; or held by your minor child.

8DEFINITIONS, EXAMPLES, AND FURTHER INSTRUCTIONS:
9    As used in this form:
10    "Asset" means an item that is owned and has monetary value.
11Assets include, but are not limited to: stocks, bonds (except
12those issued by the federal, state, or local governments),
13sector mutual funds, sector exchange traded funds, commodity
14futures, investment real estate, and partnership interests.
15"Asset" does not include: personal residences; personal
16vehicles; savings or checking accounts; bonds, notes, or
17securities issued by any branch of federal, state, or local
18government; Medicare benefits; inheritances or bequests;
19diversified mutual funds; diversified exchange traded funds;
20annuities; pensions (including government pensions);
21retirement accounts; college savings plans that are qualified
22tuition plans; or non-income producing trust holdings.
23    "Creditor" means an individual, organization, or other
24business entity to whom money or its equivalent is owed, no

2political committee registered with the Illinois State Board of

4committee, or authorized committee registered with the Federal

7making such a loan.

2that invest in a wide variety of securities.
3    "Economic opportunity" means any purchase, sale, lease,
4contract, option, or other transaction or arrangement
5involving property or services wherein the filer may gain an
6economic benefit. The term shall not include gifts.
7    "Economic relationship" means any relationship that
8provides the filer with income or an economic opportunity.
9Economic relationships include, but are not limited to,
10ownership interests in family-owned businesses and
11creditor-debtor relationships with third parties other than
12commercial lending institutions.
13    "Filer" means a person required to file a statement of
14economic interests.
15    "Family" means a filer's spouse (including a party to a
16civil union or a registered domestic partner), children,
17step-children, parents, step-parents, siblings, step-siblings,
18half-siblings, parents-in-law, brothers-in-law,
19sisters-in-law, sons-in-law, daughters-in-law, aunts, uncles,
20nieces, nephews, great aunts, great uncles, first cousins,
21grandfathers, grandmothers, grandsons, and granddaughters, as
22well as the father, mother, grandfather, and grandmother of the
23filer's spouse.
24    "Gift" means any gratuity, discount, entertainment,
25hospitality, loan, forbearance, or other tangible or
26intangible item having monetary value including, but not

1limited to, cash, food and drink, and honoraria for speaking
2engagements related to or attributable to government
3employment or the official position of an employee, member, or
4officer but does not include any item or benefit to which an
5exception in Section 10-15 of the State Officials and Employees
6Ethics Act applies.
7    "Income" means income from whatever source derived,
8including, but not limited to: compensation received for
9services rendered or to be rendered (as reported on any

3    Sec. 4A-108. Internet-based systems of filing.
4    (a) Notwithstanding any other provision of this Act or any
5other law, the Secretary of State and county clerks are a
6county clerk is authorized to institute an Internet-based
7system for the filing of statements of economic interests in
8their offices his or her office. With respect to county clerk
9systems, the The determination to institute such a system shall
10be in the sole discretion of the county clerk and shall meet
11the requirements set out in this Section. With respect to a
12Secretary of State system, the determination to institute such
13a system shall be in the sole discretion of the Secretary of
14State and shall meet the requirements set out in this Section.
15When this Section does not modify or remove the requirements
16set forth elsewhere in this Article, those requirements shall
17apply to any system of Internet-based filing authorized by this
18Section. When this Section does modify or remove the
19requirements set forth elsewhere in this Article, the
20provisions of this Section shall apply to any system of
21Internet-based filing authorized by this Section.
22    (b) In any system of Internet-based filing of statements of
23economic interests instituted by the Secretary of State or a
24county clerk:
25        (1) Any filing of an Internet-based statement of

1    economic interests shall be the equivalent of the filing of
2    a verified, written statement of economic interests as
3    required by Section 4A-101 and the equivalent of the filing
4    of a verified, dated, and signed statement of economic
5    interests as required by Section 4A-103 4A-104.
6        (2) The Secretary of State and county clerks who
7    institute A county clerk who institutes a system of
8    Internet-based filing of statements of economic interests
9    shall establish a password-protected website web site to
10    receive the filings of such statements. A website
11    established under this Section shall set forth and provide
12    a means of responding to the questions items set forth in
13    Section 4A-103 4A-102 that are required of a person who
14    files a statement of economic interests with that officer.
15        (3) The times for the filing of statements of economic
16    interests set forth in Section 4A-105 shall be followed in
17    any system of Internet-based filing of statements of
18    economic interests; provided that a candidate for elective
19    office who is required to file a statement of economic
20    interests in relation to his or her candidacy pursuant to
21    Section 4A-105(a) shall not use the Internet to file his or
22    her statement of economic interests but shall file his or
23    her statement of economic interests in a written or printed
24    form and shall receive a written or printed receipt for his
25    or her filing.
26        (4) In the first year of the implementation of a system

1    of Internet-based filing of statements of economic
2    interests, each person required to file such a statement is
3    to be notified in writing of his or her obligation to file
4    his or her statement of economic interests and the option
5    to file by way of the Internet-based system or by way of
6    standardized form. If access to the web site requires a
7    code or password, this information shall be included in the
8    notice prescribed by this paragraph.
9        (5) When a person required to file a statement of
10    economic interests has supplied the Secretary of State or a
11    county clerk, as applicable, with an email address for the
12    purpose of receiving notices under this Article by email, a
13    notice sent by email to the supplied email address shall be
14    the equivalent of a notice sent by first class mail, as set
15    forth in Section 4A-106. A person who has supplied such an
16    email address shall notify the Secretary of State or county
17    clerk, as applicable, when his or her email address changes
18    or if he or she no longer wishes to receive notices by
19    email.
20        (6) If any person who is required to file a statement
21    of economic interests and who has chosen to receive notices
22    by email fails to file his or her statement by May 10, then
23    the Secretary of State or county clerk, as applicable,
24    shall send an additional email notice on that date,
25    informing the person that he or she has not filed and
26    describing the penalties for late filing and failing to

1    file. This notice shall be in addition to other notices
2    provided for in this Article.
3        (7) Each county clerk who institutes a system of
4    Internet-based filing of statements of economic interests
5    may also institute an Internet-based process for the filing
6    of the list of names and addresses of persons required to
7    file statements of economic interests by the chief
8    administrative officers of units of local government that
9    must file such information with that county clerk pursuant
10    to Section 4A-106. Whenever a county clerk institutes such
11    a system under this paragraph, every unit of local
12    government must use the system to file this information.
13        (8) The Secretary of State and any Any county clerk who
14    institutes a system of Internet-based filing of statements
15    of economic interests shall post the contents of such
16    statements filed with him or her available for inspection
17    and copying on a publicly accessible website. Such postings
18    shall not include the addresses of the filers.
