SYNOPSIS AS INTRODUCED:
 
230 ILCS 5/31.1  from Ch. 8, par. 37-31.1

    Amends the Illinois Horse Racing Act of 1975. Provides that, in addition to certain charitable contributions to non-profit organizations that provide medical and family, counseling, and similar services to persons who reside or work on the backstretch of Illinois racetracks, organization licensees shall provide funding for no less than one Automated External Defibrillator (AED) to be placed in the paddock of their racing facilities and no less than one AED to be placed in the barn area of their racing facilities. Requires that the AEDs be accessible at all times to industry workers. Provides that qualified charitable organizations receiving the charitable contributions shall provide annual AED training, in English and Spanish, to horsemen and racetrack personnel. Requires the Board to conduct periodic checks on the AEDs and notify organization licensees to replace or repair them as needed. Effective immediately.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Horse Racing Act of 1975 is amended
5by changing Section 31.1 as follows:
 
6    (230 ILCS 5/31.1)  (from Ch. 8, par. 37-31.1)
7    Sec. 31.1. (a) Organization licensees collectively shall
8contribute annually to charity the sum of $750,000 to
9non-profit organizations that provide medical and family,
10counseling, and similar services to persons who reside or work
11on the backstretch of Illinois racetracks. These contributions
12shall be collected as follows: (i) no later than July 1st of
13each year the Board shall assess each organization licensee,
14except those tracks which are not within 100 miles of each
15other which tracks shall pay $30,000 annually apiece into the
16Board charity fund, that amount which equals $690,000
17multiplied by the amount of pari-mutuel wagering handled by the
18organization licensee in the year preceding assessment and
19divided by the total pari-mutuel wagering handled by all
20Illinois organization licensees, except those tracks which are
21not within 100 miles of each other, in the year preceding
22assessment; (ii) notice of the assessed contribution shall be
23mailed to each organization licensee; (iii) within thirty days

1of its receipt of such notice, each organization licensee shall
2remit the assessed contribution to the Board. If an
3organization licensee wilfully fails to so remit the
4contribution, the Board may revoke its license to conduct horse
5racing.
6    (b) In addition to the moneys described in subsection (a)
7of this Section, organization licensees shall provide funding
8for no less than one Automated External Defibrillator (AED) to
9be placed in the paddock of their racing facilities and no less
10than one AED to be placed in the barn area of their racing
11facilities. The AEDs shall be accessible at all times to
12industry workers. Qualified charitable organizations receiving
13moneys under this Section shall provide annual AED training, in
14English and Spanish, to horsemen and racetrack personnel. The
15Board shall conduct periodic checks on the AEDs and notify
16organization licensees to replace or repair them as needed.
17    (c) (b) No later than October 1st of each year, any
18qualified charitable organization seeking an allotment of
19contributed funds shall submit to the Board an application for
20those funds, using the Board's approved form. No later than
21December 31st of each year, the Board shall distribute all such
22amounts collected that year to such charitable organization
23applicants.

25    Section 99. Effective date. This Act takes effect upon
26becoming law.
