AMENDMENT TO HOUSE BILL 1947

2    AMENDMENT NO. ______. Amend House Bill 1947 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Liquor Control Act of 1934 is amended by
5adding Section 6-36 as follows:
 
6    (235 ILCS 5/6-36 new)
7    Sec. 6-36. Homemade brewed beer.
8    (a) A business engaged primarily in selling supplies and
9equipment for use by homebrewers may manufacture homemade
10brewed beer for the purpose of tasting the beer at the place of
11business, provided the homemade brewed beer is not sold or
12offered for sale. Homemade brewed beer provided at a business
13for tasting under this subsection (a) shall be in compliance
14with Sections 6-16, 6-21, and 6-31 of this Act. A business
15engaged primarily in selling supplies and equipment for use by
16homebrewers shall not be required to secure a license pursuant

1to Section 10-7.1, however, such business shall secure liquor
2liability insurance coverage in an amount at least equal to the
3maximum liability amounts set forth in subsection (a) of
4Section 6-21 of this Act.
5    (b) The manufacture and tasting of homemade brewed beer at
6a private residence is permitted for educational purposes,
7provided that the homemade brewed beer is not sold or offered
8for sale and quantities shall be limited as provided in Section
96-31 of this Act.
10    (c) For the purposes of this Section, "homemade brewed
11beer" means beer that is obtained by the alcoholic fermentation
12of an infusion or concoction of barley, or other grain, malt,
13and hops in water, and includes, but is not limited to, beer,
14ale, stout, lager beer, porter, and mead.
15    (d) The manufacture of homemade brewed beer shall be
16subject to the following limitations:
17        (1) the homemade brewed beer shall be made by a person
18    21 years of age or older at the person's residence, another
19    location with permission from the property owner, or at a
20    business engaged primarily in selling supplies and
21    equipment for use by home brewers for consumption by such
22    person or such person's family and guests;
23        (2) the person who makes the homemade brewed beer
24    receives no compensation;
25        (3) the homemade brewed beer is not sold or offered for
26    sale;

1        (4) the total quantity of homemade brewed beer made in
2    a calendar year by the person shall not exceed 100 gallons
3    if the household has only one person 21 years of age or
4    older or 200 gallons if the household has 2 or more persons
5    21 years of age or older; and
6        (5) the homemade brewed beer shall not be made for a
7    commercial purpose.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.".
