SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-335

    Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that the Illinois Transparency and Accountability Portal (ITAP) shall include information on the employees and individual consultants, expenditures, grant funds received, contracts of all units of local government with taxing powers, and unfunded obligations of the State. Defines "unit of local government". Provides that ITAP shall include information on the funding ratio and the rate of return on investment for local pension funds and the Illinois Municipal Retirement Fund. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-335 as follows:
 
7    (20 ILCS 405/405-335)
8    Sec. 405-335. Illinois Transparency and Accountability
9Portal (ITAP).
10    (a) The Department, within 12 months after January 1, 2010
11the effective date of this amendatory Act of the 96th General
12Assembly, shall establish and maintain a website, known as the
13Illinois Transparency and Accountability Portal (ITAP), with a
14full-time webmaster tasked with compiling and updating the ITAP
15database with information received from all State agencies as
16defined in this Section. Subject to appropriation, the
17full-time webmaster must also compile and update the ITAP
18database with information received from all counties,
19townships, and municipalities.
20    (a-5) The Department, within 12 months after the effective
21date of this amendatory Act of the 98th General Assembly, shall
22compile and update the ITAP database with information received
23from each unit of local government according to subsection

1(c-5) of this Section.
2    (b) For purposes of this Section:
3    "State agency" means the offices of the constitutional
4officers identified in Article V of the Illinois Constitution,
5executive agencies, and departments, boards, commissions, and
6Authorities under the Governor.
7    "Contracts" means payment obligations with vendors on file
8with the Office of the Comptroller to purchase goods and
9services exceeding $10,000 in value (or, in the case of
10professional or artistic services, exceeding $5,000 in value).
11    "Appropriation" means line-item detail of spending
12approved by the General Assembly and Governor, categorized by
13object of expenditure.
14    "Individual consultants" means temporary workers eligible
15to receive State benefits paid on a State payroll.
16    "Recipients" means State agencies receiving
17appropriations.
18    "Unit of local government" or "local government" includes,
19without limitation, counties, townships, municipalities,
20community college districts, school districts, special purpose
21districts, and any other unit of government with the power to
22levy taxes. "Unit of local government" or "local government"
23does not include a State agency as defined in this subsection.
24    (c) The ITAP shall provide direct access to each of the
25following:
26        (1) A database of all current State employees and

1    individual consultants, except sworn law enforcement
2    officers, sorted separately by:
3            (i) Name.
4            (ii) Employing State agency.
5            (iii) Employing State division.
6            (iv) Employment position title.
7            (v) Current pay rate and year-to-date pay.
8        (2) A database of all current State expenditures,
9    sorted separately by agency, category, recipient, and
10    Representative District.
11        (3) A database of all development assistance
12    reportable pursuant to the Corporate Accountability for
13    Tax Expenditures Act, sorted separately by tax credit
14    category, taxpayer, and Representative District.
15        (4) A database of all revocations and suspensions of
16    State occupation and use tax certificates of registration
17    and all revocations and suspensions of State professional
18    licenses, sorted separately by name, geographic location,
19    and certificate of registration number or license number,
20    as applicable. Professional license revocations and
21    suspensions shall be posted only if resulting from a
22    failure to pay taxes, license fees, or child support.
23        (5) A database of all current State contracts, sorted
24    separately by contractor name, awarding officer or agency,
25    contract value, and goods or services provided.
26        (6) A database of all employees hired after the

1    effective date of this amendatory Act of 2010, sorted
2    searchably by each of the following at the time of
3    employment:
4            (i) Name.
5            (ii) Employing State agency.
6            (iii) Employing State division.
7            (iv) Employment position title.
8            (v) Current pay rate and year-to-date pay.
9            (vi) County of employment location.
10            (vii) Rutan status.
11            (viii) Status of position as subject to collective
12        bargaining, subject to merit compensation, or exempt
13        under Section 4d of the Personnel Code.
14            (ix) Employment status as probationary, trainee,
15        intern, certified, or exempt from certification.
16            (x) Status as a military veteran.
17        (7) (Blank). A searchable database of all current
18    county, township, and municipal employees sorted
19    separately by:
20            (i) Employing unit of local government.
21            (ii) Employment position title.
22            (iii) Current pay rate and year-to-date pay.
23        (8) (Blank). A searchable database of all county,
24    township, and municipal employees hired on or after the
25    effective date of this amendatory Act of the 97th General
26    Assembly, sorted separately by each of the following at the

1    time of employment:
2            (i) Employing unit of local government.
3            (ii) Employment position title.
4            (iii) Current pay rate and year-to-date pay.
5    (c-5) The ITAP shall provide direct access to each of the
6following for each unit of local government:
7        (1) A database of all current local government
8    employees and individual consultants, except sworn law
9    enforcement officers, sorted separately by:
10            (i) Name.
11            (ii) Employing unit of local government.
12            (iii) Employment position title.
13            (iv) Current pay rate and year-to-date pay.
14    This database shall incorporate all information previously
15reported under items (7) and (8) of subsection (c) of this
16Section.
17        (2) A database of all current local government
18    expenditures, sorted separately by unit of local
19    government, category, and recipient.
20        (3) A database of all grant funds received from any
21    State agency, sorted separately by unit of local
22    government, State agency, and type and purpose of grant.
23        (4) A database of all current local government
24    contracts, sorted separately by contractor name, awarding
25    officer or unit of local government, contract value, and
26    goods or services provided.

1        (5) A database of all employees hired after the
2    effective date of this amendatory Act of the 98th General
3    Assembly, sorted searchably by each of the following at the
4    time of employment:
5            (i) Name.
6            (ii) Employing unit of local government.
7            (iii) Employment position title.
8            (iv) Current pay rate and year-to-date pay.
9        (6) A database of all unfunded contractual
10    obligations, including (i) employee pensions and (ii)
11    employee and retiree health care costs.
12        (7) A database with information on each unit of local
13    government's enumerated pension plan including the total
14    invested capital, the plan's ratio of funding to
15    liabilities, and the rate of return on that plan's
16    investments. The database shall also include the total
17    invested capital and the rate of return on investments for
18    the Illinois Municipal Retirement Fund, together with the
19    names of each unit of local government participating in the
20    Illinois Municipal Retirement Fund. The Department shall
21    by rule specify the level of detail that shall be made
22    available on ITAP under this item.
23    (d) The ITAP shall include all information required to be
24published by subsections subsection (c) and (c-5) of this
25Section that is available to the Department in a format the
26Department can compile and publish on the ITAP. The Department

1shall update the ITAP as additional information becomes
2available in a format that can be compiled and published on the
3ITAP by the Department.
4    (e) Each State agency, county, township, and municipality,
5or other unit of local government shall cooperate with the
6Department in furnishing the information necessary for the
7implementation of this Section within a timeframe specified by
8the Department.
9    (f) Each county, township, or municipality, or other unit
10of local government submitting information to be displayed on
11the Illinois Transparency and Accountability Portal (ITAP) is
12responsible for the accuracy of the information provided.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
