AMENDMENT TO SENATE BILL 3344

2    AMENDMENT NO. ______. Amend Senate Bill 3344 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Criminal Identification Act is amended by
5adding Section 11.5 as follows:
 
6    (20 ILCS 2630/11.5 new)
7    Sec. 11.5. Expungement and sealing information. The county
8public defender and circuit court clerk shall provide
9information to persons eligible to have their arrest or
10criminal history records expunged or sealed, which clearly and
11concisely explains the expungement and sealing eligibility
12requirements and procedure to apply for the expungement or
13sealing of eligible records. The county public defender and
14circuit court clerk may comply with this requirement by:
15        (1) providing access to this information by means of a
16    hyperlink labeled "Expungement and Sealing" on their or the

1    county's World Wide Web homepage; or
2        (2) providing a link to the State Appellate Defender's
3    World Wide Web homepage expungement and sealing
4    information hyperlink; and
5        (3) making the State Appellate Defender's expungement
6    and sealing instruction guide developed under Section 11
7    available for inspection in their respective office or the
8    county courthouse.
 
9    Section 10. The Counties Code is amended by adding Section
103-4006.5 as follows:
 
11    (55 ILCS 5/3-4006.5 new)
12    Sec. 3-4006.5. Expungement and sealing information. The
13Public Defender shall provide information to persons eligible
14to have their arrest or criminal history records expunged or
15sealed, which clearly and concisely explains the expungement
16and sealing eligibility requirements and procedure to apply for
17the expungement or sealing of eligible records. The Public
18Defender may comply with this requirement by:
19        (1) providing access to this information by means of a
20    hyperlink labeled "Expungement and Sealing" on their or the
21    county's World Wide Web homepage; or
22        (2) providing a link to the State Appellate Defender's
23    World Wide Web homepage expungement and sealing
24    information hyperlink; and

1        (3) making the State Appellate Defender's expungement
2    and sealing instruction guide developed under Section 11 of
3    the Criminal Identification Act available for inspection
4    in the Public Defender's office or the county courthouse.
 
5    Section 15. The Clerks of Courts Act is amended by adding
6Section 13.5 as follows:
 
7    (705 ILCS 105/13.5 new)
8    Sec. 13.5. Expungement and sealing information. The clerks
9shall provide information to persons eligible to have their
10arrest or criminal history records expunged or sealed, which
11clearly and concisely explains the expungement and sealing
12eligibility requirements and procedure to apply for the
13expungement or sealing of eligible records. The clerks may
14comply with this requirement by:
15        (1) providing access to this information by means of a
16    hyperlink labeled "Expungement and Sealing" on their or the
17    county's World Wide Web homepage; or
18        (2) providing a link to the State Appellate Defender's
