AMENDMENT TO SENATE BILL 1859

AMENDMENT NO. ______. Amend Senate Bill 1859 by replacing everything after the enacting clause with the following:

"Section 5. The Good Samaritan Act is amended by adding Section 73 as follows:

(745 ILCS 49/73 new)

Sec. 73. School personnel; exemption from civil liability for emergency care. Any school personnel who in good faith provide emergency medical or first aid care without fee to any other school personnel or to any student enrolled in the school district shall not, as a result of their acts or omissions, except willful and wanton misconduct on the part of the school personnel in providing the care, be liable to the person to whom such care is provided for civil damages. For purposes of this Section, "school personnel" means persons employed by, on contract with, or serving as authorized volunteers in a school district. This Section does not apply to any school personnel who are licensed physicians, nurses, dentists, or other licensed health services personnel. This Section does not affect or in any way diminish or change an employer's liability under the Workers' Compensation Act or the Workers' Occupational Diseases Act.

Section 99. Effective date. This Act takes effect upon becoming law.".
