AMENDMENT TO SENATE BILL 1354

2     AMENDMENT NO. ______. Amend Senate Bill 1354 as follows:
 
3 on page 1, line 5, by replacing "Section" with "Sections 1
4 and"; and
 
5 on page 1, immediately below line 5, by inserting the
6 following:
 
7     "Section 5. The Vital Records Act is amended by changing
8 Section 1 as follows:
 
9     (410 ILCS 535/1)  (from Ch. 111 1/2, par. 73-1)
10     Sec. 1. As used in this Act, unless the context otherwise
11 requires:
12     (1) "Vital records" means records of births, deaths, fetal
13 deaths, marriages, dissolution of marriages, and data related
14 thereto.

1     (2) "System of vital records" includes the registration,
2 collection, preservation, amendment, and certification of
3 vital records, and activities related thereto.
4     (3) "Filing" means the presentation of a certificate,
5 report, or other record provided for in this Act, of a birth,
6 death, fetal death, adoption, marriage, or dissolution of
7 marriage, for registration by the Office of Vital Records.
8     (4) "Registration" means the acceptance by the Office of
9 Vital Records and the incorporation in its official records of
10 certificates, reports, or other records provided for in this
11 Act, of births, deaths, fetal deaths, adoptions, marriages, or
12 dissolution of marriages.
13     (5) "Live birth" means the complete expulsion or extraction
14 from its mother of a product of human conception, irrespective
15 of the duration of pregnancy, which after such separation
16 breathes or shows any other evidence of life such as beating of
17 the heart, pulsation of the umbilical cord, or definite
18 movement of voluntary muscles, whether or not the umbilical
19 cord has been cut or the placenta is attached.
20     (6) "Fetal death" means death prior to the complete
21 expulsion or extraction from its mother of a product of human
22 conception, irrespective of the duration of pregnancy; the
23 death is indicated by the fact that after such separation the
24 fetus does not breathe or show any other evidence of life such
25 as beating of the heart, pulsation of the umbilical cord, or
26 definite movement of voluntary muscles.

1     (7) "Dead body" means a lifeless human body or parts of
2 such body or bones thereof from the state of which it may
3 reasonably be concluded that death has occurred.
4     (8) "Final disposition" means the burial, cremation, or
5 other disposition of a dead human body or fetus or parts
6 thereof.
7     (9) "Physician" means a person licensed to practice
8 medicine in Illinois or any other State.
9     (10) "Institution" means any establishment, public or
10 private, which provides in-patient medical, surgical, or
11 diagnostic care or treatment, or nursing, custodial, or
12 domiciliary care to 2 or more unrelated individuals, or to
13 which persons are committed by law.
14     (11) "Department" means the Department of Public Health of
15 the State of Illinois.
16     (12) "Director" means the Director of the Illinois
17 Department of Public Health.
18     (13) "Medical treatment" means any surgical operation or
19 other medical procedure causing irreversible gender change.

22 following:
23     "(d) An affidavit by a physician that he has performed an
24 operation on a person has undergone medical treatment, and that
25 by reason of the medical treatment operation the sex

1 designation on such person's birth record should be changed.
2 The State Registrar of Vital"; and
