AMENDMENT TO SENATE BILL 329

2     AMENDMENT NO. ______. Amend Senate Bill 329 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois International Port District Act is
5 amended by changing Section 4 and by adding Section 28 as
6 follows:
 
7     (70 ILCS 1810/4)  (from Ch. 19, par. 155)
8     Sec. 4. It shall be the duty of the Port District:
9     (a) To study the existing harbor plans within the area of
10 the Port District and to recommend to the appropriate
11 governmental agency, including the General Assembly of
12 Illinois, such changes and modifications as may from time to
13 time be required by the continuing development therein and to
14 meet changing business and commercial needs.
15     (b) To make an investigation of conditions within the area
16 of the Port District and to prepare and adopt a comprehensive

1 plan for the development of the port facilities for the said
2 Port District. In preparing and recommending changes and
3 modifications in existing harbor plans, or a comprehensive plan
4 for the development of said port facilities, as above provided,
5 the District may if it deems desirable set aside and allocate
6 an area, or areas, within the lands held by it, to be used and
7 operated by the District or leased to private parties for
8 industrial, manufacturing, commercial, recreational, or harbor
9 purposes, where such area or areas are not, in the opinion of
10 the District, required for its primary purposes in the
11 development of harbor and port facilities for the use of public
12 water and land transportation, or will not be immediately
13 needed for such purposes, and where such use and operation or
14 leasing will in the opinion of the District aid and promote the
15 development of terminal and port facilities.
16     (c) To study and make recommendations to the proper
17 authority for the improvement of terminal, lighterage,
18 wharfage, warehousing, transfer and other facilities necessary
19 for the promotion of commerce and the interchange of traffic
20 within, to and from the Port District.
21     (d) To study, prepare and recommend by specific proposals
22 to the General Assembly of Illinois changes in the jurisdiction
23 of the Port District.
24     (e) To petition any federal, state, municipal or local
25 authority, administrative, judicial and legislative, having
26 jurisdiction in the premises, for the adoption and execution of

1 any physical improvement, change in method, system of handling
2 freight, warehousing, docking, lightering and transfer of
3 freight, which in the opinion of the Port District may be
4 designed to improve or better the handling of commerce in and
5 through the Port District or improve terminal or transportation
6 facilities therein.
7     (f) To foster, stimulate and promote the shipment of
8 cargoes and commerce through such ports, whether originating
9 within or without the State of Illinois.
10     (g) To acquire, construct, own, lease and develop
11 terminals, wharf facilities, piers, docks, warehouses, bulk
12 terminals, grain elevators, tug boats and other harbor crafts,
13 and any other port facility or port-related facility or service
14 as it finds necessary and convenient.
15     (h) To perform any other act or function which may tend to
16 or be useful toward development and improvement of harbors, sea
17 ports, and port-related facilities and services and to increase
18 foreign and domestic commerce through the harbors and ports
19 within the City of Chicago.
20     (i) After the effective date of this amendatory Act of the
21 96th General Assembly, the duties of the District shall be
22 assumed by the City of Chicago.

25     Sec. 28. Dissolution of Illinois International Port

1 District; disposition of land and real estate.
2     (a) Notwithstanding any provision of law to the contrary,
3 the Illinois International Port District is dissolved by
4 operation of law one year after the effective date of this
5 amendatory Act of the 96th General Assembly.
6     (b) On or before the day 2 months after the effective date
7 of this amendatory Act of the 96th General Assembly, the Board
8 of Directors shall forward to the City of Chicago all
9 transition plans relating to the consolidation of all of the
10 existing programs, personnel, and infrastructure of the
11 District into the City of Chicago to be administered by the
12 City. Beginning on the effective date of this amendatory Act of
13 the 96th General Assembly, the District shall not make any
14 enhancements to pensions.
15     (c) Upon dissolution of the District: (i) all assets and
16 liabilities of the Illinois International Port District
17 dissolved under this amendatory Act of the 96th General
18 Assembly shall be transferred to the City of Chicago and the
19 monetary assets shall be deposited into a special purpose fund
20 for the development and improvement of harbors, sea ports, and
21 port related facilities and services and to increase foreign
22 and domestic commerce through the harbors and ports within the
23 City of Chicago; (ii) the City of Chicago shall assume all
24 duties and responsibilities enumerated in Section 4; and (iii)
25 employees of the Illinois International Port District become
26 employees of the City of Chicago.

1     (d) The City Council of the City of Chicago may transfer to
2 the Chicago Park District or the Cook County Forest Preserve
3 District appropriate unimproved or improved recreational real
4 estate owned by the Illinois International Port District at the
5 time of its dissolution. After the dissolution of the District,
6 any land owned by the District at the time of its dissolution
7 remains subject to any leases and encumbrances that existed
8 upon the dissolution of the District and, if the land is
9 subject to a lease, the land may not be taken by any unit of
10 government during the term of the lease.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.".
