SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/3-11004.1 new

    Amends the Counties Code. Provides that the Cook County Treasurer must post on his or her official website uncashed checks issued in the regular course of county business to Cook County residents. Provides that the checks must be for an amount of $5 or more. Specifies other requirements. Requires that the Cook County Treasurer post the procedure for a person to receive a replacement check. Limits home rule powers.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 3-11004.1 as follows:
 
6     (55 ILCS 5/3-11004.1 new)
7     Sec. 3-11004.1. Posting requirements for uncashed checks.
8 No later than 60 days after the effective date of this
9 amendatory Act of the 96th General Assembly, for the purpose of
10 assisting Cook County residents in reclaiming uncashed checks
11 issued by Cook County, the Cook County Treasurer must post on
12 the Cook County Treasurer's official website information
13 related to uncashed checks issued in the regular course of
14 county business to Cook County residents. The Cook County
15 Treasurer must also post the procedure for a person to receive
16 a replacement check. The checks must be for an amount of $5 or
17 more. This Section applies only to a check that remains
18 uncashed by the payee for no less than one year and no more
19 than 5 years from its issue date.
20     Cook County may not provide notice of uncashed checks in a
21 manner inconsistent with the provisions of this Section. This
22 Section is a limitation under subsection (i) of Section 6 of
23 Article VII of the Illinois Constitution on the concurrent

1 exercise by home rule units of powers and functions exercised
2 by the State.
