SYNOPSIS AS INTRODUCED:
 
705 ILCS 105/12.1 new

    Amends the Clerks of Courts Act. Provides that when the circuit clerk is required to provide notice to a party, and the party has registered an electronic address with the circuit clerk, the circuit clerk may provide the notice via the electronic address. Provides that the circuit clerk shall maintain a copy of the electronic content and a delivery receipt in his or her records. Provides that electronic notices shall have the same effect as a hard copy notice. Effective immediately.

1     AN ACT concerning courts.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Clerks of Courts Act is amended by adding
5 Section 12.1 as follows:
 
6     (705 ILCS 105/12.1 new)
7     Sec. 12.1. Electronic notice. When the circuit clerk is
8 required to provide notice to a party, and the party has
9 registered an electronic address with the circuit clerk, the
10 circuit clerk may provide the required notice via the
11 registered electronic address. The circuit clerk shall
12 maintain a copy of the electronic content and a delivery
13 receipt as part of the records of his or her office. Electronic
14 notices shall have the same effect as a hard copy notice.
 
15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
