SYNOPSIS AS INTRODUCED:

30 ILCS 105/5.721 new

    Amends the Mold Remediation Registration Act. Provides that the Department of Public Health must (instead of may) adopt rules to implement a program for parties that provide mold remediation services to register with the State. Provides that the Department must submit emergency rules to the Joint Committee on Administrative Rules to implement the registration of mold remediation professionals. Provides that the Department may charge a registration fee to cover the costs of administering and enforcing the Act. Provides that moneys collected pursuant to the registration of mold remediation professionals shall be deposited into the Mold Remediation Registration Fund. Amends the State Finance Act to create the Mold Remediation Registration Fund.

1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mold Remediation Registration Act is amended
5 by changing Section 20 as follows:
 
6     (410 ILCS 105/20)
7     Sec. 20. Rules. The Department must may adopt rules, under
8 the Illinois Administrative Procedure Act, to implement a
9 program establishing procedures for parties that provide mold
10 remediation services to register with the State and provide
11 evidence of financial responsibility. Not later than 3 months
12 after the effective date of this amendatory Act of the 96th
13 General Assembly, the Department must submit emergency rules to
14 the Joint Committee on Administrative Rules under the Illinois
15 Administrative Procedures Act to implement the registration of
16 mold remediation professionals. The Department may charge a
17 registration fee to cover the costs of administering and
18 enforcing this Act.
19     The Mold Remediation Registration Fund is established as a
20 special fund in the State treasury. Moneys collected for
21 registration of mold remediation professionals shall be
22 deposited into the Fund and used for the purpose of
23 administering and enforcing this Act.
