SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-2.07 new

    Amends the Illinois Public Aid Code. Provides that no later than July 1, 2007, subject to federal approval of a State Medicaid Plan amendment, which shall be sought by the Department of Healthcare and Family Services or its successor agency, persons who fail to qualify for basic maintenance under the Aid to the Aged, Blind or Disabled (AABD) program on the basis of need because of excess income or assets, or both, may establish prospective eligibility for that basic maintenance by paying their monthly Medicaid spend-down amount to the Department of Healthcare and Family Services or by having a third party pay that amount to the Department.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-2.07 as follows:
 
6     (305 ILCS 5/5-2.07 new)
7     Sec. 5-2.07. Use of Medicaid spend-down. No later than July
8 1, 2007, subject to federal approval of a State Medicaid Plan
9 amendment, which shall be sought by the Department of
10 Healthcare and Family Services or its successor agency, persons
11 described in item 2(a) of Section 5-2, who fail to qualify for
12 basic maintenance under Article III of this Code on the basis
13 of need because of excess income or assets, or both, may
14 establish eligibility for medical assistance by paying the
15 amount of their monthly spend-down under this Article (as
16 described in 42 CFR 435.831) to the Department of Healthcare
17 and Family Services or its successor agency or by having a
18 third party pay that amount to the Department on their behalf.
