| AMENDMENT NO. ______. Amend House Bill 759 by replacing | 3 |
| everything after the enacting clause with the following:

| "Section 5. The Children and Family Services Act is amended | 5 |
| by adding Section 5.25 as follows: | 6 |
| (20 ILCS 505/5.25 new) | 7 |
| Sec. 5.25. Behavioral health services.
| 8 |
| (a) Every child in the care of the Department of Children | 9 |
| and Family Services under this Act shall receive the necessary | 10 |
| behavioral health services including but not limited to: mental | 11 |
| health services, trauma services, substance abuse services, | 12 |
| and developmental disabilities services. The provision of | 13 |
| these services may be provided in milieu including but not | 14 |
| limited to: integrated assessment, treatment plans, individual | 15 |
| and group therapy, specialized foster care, community based | 16 |
| programming, licensed residential services, psychosocial | 17 |
| rehabilitation, screening assessment and support services, | 18 |
| hospitalization, and transitional planning and referral to the | 19 |
| Department of Human Services for appropriate services when the | 20 |
| child reaches adulthood.
Services shall be appropriate to meet | 21 |
| the needs of the individual child and may be provided to the | 22 |
| child at the site of the program, facility, or foster home or | 23 |
| at an otherwise appropriate location. A program facility, or | 24 |
| home, shall assist the Department staff in arranging for a |

| child to receive behavioral health services from an outside | 2 |
| provider when those services are necessary to meet the child's | 3 |
| needs and the child wishes to receive them. | 4 |
| (b) Not later than January 1, 2006, the Department shall | 5 |
| file a proposed rule or a proposed amendment to an existing | 6 |
| rule regarding the provision of behavioral health services to | 7 |
| children who have serious behavioral health needs. The proposal | 8 |
| shall address, but is not limited to, the implementation of the | 9 |
| following: integrated assessment, treatment plans, individual | 10 |
| and group therapy, specialized foster care, community based | 11 |
| programming, licensed residential services, psychosocial | 12 |
| rehabilitation, hospitalization, and transitional planning and | 13 |
| referral to the Department of Human Services for appropriate | 14 |
| services when the child reaches adulthood. | 15 |
| (c) In preparation for the comprehensive implementation of | 16 |
| the behavioral health system, the Department shall also prepare | 17 |
| an assessment of behavioral health community services | 18 |
| available to the Department in the State. The assessment shall | 19 |
| evaluate the resources needed in each region to provide | 20 |
| appropriate behavioral health services for all of the | 21 |
| Department's foster children within the region's service area | 22 |
| who are in need of behavioral health services. The assessments | 23 |
| shall include, at a minimum, an analysis of the current | 24 |
| availability and needs in each of the following areas: | 25 |
| comprehensive integrated assessment, trauma services, mental | 26 |
| health treatment, qualified mental health professionals, | 27 |
| community providers, programs for psychosocial rehabilitation, | 28 |
| and programs for substance abuse.
By January 1, 2007, the | 29 |
| Department shall complete all required individual and regional | 30 |
| assessments and shall submit a written report to the Governor | 31 |
| and the General Assembly that describes the results of the | 32 |
| assessment and contains a specific plan to address the | 33 |
| identified needs for services. ".
