1     AN ACT concerning children.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Children and Family Services Act is amended
5 by adding Section 5.25 as follows:
 
6     (20 ILCS 505/5.25 new)
7     Sec. 5.25. Behavioral health services.
8     (a) Every child in the care of the Department of Children
9 and Family Services under this Act shall receive the necessary
10 behavioral health services including but not limited to: mental
11 health services, trauma services, substance abuse services,
12 and developmental disabilities services. The provision of
13 these services may be provided in milieu including but not
14 limited to: integrated assessment, treatment plans, individual
15 and group therapy, specialized foster care, community based
16 programming, licensed residential services, psychosocial
17 rehabilitation, screening assessment and support services,
18 hospitalization, and transitional planning and referral to the
19 Department of Human Services for appropriate services when the
20 child reaches adulthood. Services shall be appropriate to meet
21 the needs of the individual child and may be provided to the
22 child at the site of the program, facility, or foster home or
23 at an otherwise appropriate location. A program facility, or
24 home, shall assist the Department staff in arranging for a
25 child to receive behavioral health services from an outside
26 provider when those services are necessary to meet the child's
27 needs and the child wishes to receive them.
28     (b) Not later than January 1, 2006, the Department shall
29 file a proposed rule or a proposed amendment to an existing
30 rule regarding the provision of behavioral health services to
31 children who have serious behavioral health needs. The proposal
32 shall address, but is not limited to, the implementation of the

1 following: integrated assessment, treatment plans, individual
2 and group therapy, specialized foster care, community based
3 programming, licensed residential services, psychosocial
4 rehabilitation, hospitalization, and transitional planning and
5 referral to the Department of Human Services for appropriate
6 services when the child reaches adulthood.
7     (c) In preparation for the comprehensive implementation of
8 the behavioral health system, the Department shall also prepare
9 an assessment of behavioral health community services
10 available to the Department in the State. The assessment shall
11 evaluate the resources needed in each region to provide
12 appropriate behavioral health services for all of the
13 Department's foster children within the region's service area
14 who are in need of behavioral health services. The assessments
15 shall include, at a minimum, an analysis of the current
16 availability and needs in each of the following areas:
17 comprehensive integrated assessment, trauma services, mental
18 health treatment, qualified mental health professionals,
19 community providers, programs for psychosocial rehabilitation,
20 and programs for substance abuse. By January 1, 2007, the
21 Department shall complete all required individual and regional
22 assessments and shall submit a written report to the Governor
23 and the General Assembly that describes the results of the
24 assessment and contains a specific plan to address the
25 identified needs for services.
