 1                    AMENDMENT TO SENATE BILL 155

 2        AMENDMENT NO.     .  Amend Senate Bill 155  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The Illinois Procurement Code is amended by
 5    adding Section 30-22 as follows:

 6        (30 ILCS 500/30-22 new)
 7        Sec. 30-22.  Partial waiver program pilot project.
 8        (a)  The  Illinois  Department  of  Transportation  shall
 9    conduct a pilot project to commence on January 1, 2004. Under
10    the pilot project the Department  shall  not  pay  a  general
11    contractor   under   contract   with   the  Department  on  a
12    multi-phase project for any part of the second or later phase
13    of the project until the  general  contractor  has  paid  all
14    subcontractors  the  amount  they  are owed for any completed
15    phase of the project.
16        The Department may implement the pilot  project  for  the
17    current phase of a project begun before January 1, 2004.
18        The  Department  shall  adopt  rules  to determine when a
19    phase is completed.
20        (b)  The  Illinois  Department  of  Transportation  shall
21    submit a report to the General Assembly on or before December
22    31, 2005 concerning the results of the pilot project.

 1        Section 99.  Effective date. This Act takes  effect  upon
 2    becoming law.".
