AMENDMENT TO HOUSE BILL 6366

2     AMENDMENT NO. ______. Amend House Bill 6366 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Fireworks Regulation Act of Illinois is
5 amended by changing Section 2 as follows:
 
6     (425 ILCS 30/2)  (from Ch. 127 1/2, par. 102)
7     Sec. 2. The following words and phrases, when used in this
8 Act, shall for the purpose of this Act have the following
9 definition and meaning:
10     (a) The term fireworks shall mean and include any explosive
11 composition or any substance or combination of substances, or
12 article prepared for the purpose of producing a visible or
13 audible effect of a temporary exhibitional nature by explosion,
14 combustion, deflagration or detonation, and shall include
15 blank cartridges, toy cannons in which explosives are used, the
16 type of balloons which require fire underneath to propel the
17 same, firecrackers, torpedoes, sky rockets, Roman candles,
18 bombs or other fireworks of like construction and any fireworks
19 containing any explosive compound; or any tablets or other
20 device containing any explosive substance, or containing
21 combustible substances producing visual effects. The term
22 "fireworks" shall not include snake or glow worm pellets; smoke
23 devices; sparklers or sparkling devices, whether handheld or
24 ground based, of not more than one hundred grams of pyrotechnic

1 mixture per tube, which are nonexplosive and non-aerial; trick
2 noisemakers known as "party poppers", "booby traps",
3 "snappers", "trick matches", "cigarette loads" and "auto
4 burglar alarms"; toy pistols, toy canes, toy guns, or other
5 devices in which paper or plastic caps containing twenty-five
6 hundredths grains or less of explosive compound are used,
7 provided they are so constructed that the hand cannot come in
8 contact with the cap when in place for the explosion; and toy
9 pistol paper or plastic caps which contain less than
10 twenty-five hundredths grains of explosive mixture; the sale
11 and use of which shall be permitted at all times.
12     (b) The term "fireworks plant" shall mean and include all
13 lands, with buildings thereon, used in connection with the
14 manufacture or processing of fireworks, as well as storehouses
15 located thereon for the storage of finished fireworks.
16     (c) The term "fireworks factory building" shall mean any
17 building or other structure in which the manufacture of
18 fireworks, or in which any processing involving fireworks is
19 carried on.
20     (d) The term "magazine" shall mean any building or other
21 structure used for the storage of explosive raw materials used
22 in the manufacture of fireworks.
23     (e) The term "Office" shall mean the Office of the State
24 Fire Marshal.

26     Section 10. The Fireworks Use Act is amended by changing
27 Section 1 as follows:

29     Sec. 1. The term fireworks shall mean and include any
30 explosive composition, or any substance or combination of
31 substances, or article prepared for the purpose of producing a

2 include blank cartridges, toy cannons, in which explosives are
3 used, the type of balloons which require fire underneath to

5 candles, bombs, or other fireworks of like construction and any
6 fireworks containing any explosive compound, or any tablets or
7 other device containing any explosive substance, or containing
8 combustible substances producing visual effects: provided,
9 however, that the term "fireworks" shall not include snake or
10 glow worm pellets; smoke devices; trick noisemakers known as
