 1                    AMENDMENT TO HOUSE BILL 2864

 2        AMENDMENT NO.     .  Amend House Bill 2864  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The  School  Code  is  amended by changing
 5    Section 14-1.09b as follows:

 6        (105 ILCS 5/14-1.09b)
 7        Sec. 14-1.09b.  Speech-language pathologist.
 8        (a)  For purposes of  supervision  of  a  speech-language
 9    pathology  assistant,  "speech-language  pathologist" means a
10    person who has received a license pursuant  to  the  Illinois
11    Speech-Language  Pathology  and  Audiology  Practice  Act  to
12    engage in the practice of speech-language pathology.
13        (b)  The  School  Service  Personnel  Certificate  with a
14    speech-language endorsement shall  be  issued  under  Section
15    21-25 of this Code to a speech-language pathologist who meets
16    all of the following requirements:
17             (1)  Holds   (A)  a  license  as  a  speech-language
18        pathologist  pursuant  to  the  Illinois  Speech-Language
19        Pathology and Audiology Practice Act  or  (B)  a  current
20        Certificate  of  Clinical  Competence  in speech-language
21        pathology  from  the   American   Speech-Language-Hearing
22        Association  and  a  regular  license  in speech-language

 1        pathology from another state or territory or the District
 2        of Columbia.
 3             (2) Holds a master's or doctoral degree with a major
 4        emphasis in speech-language pathology from an institution
 5        whose  course  of  study  was  approved  or  program  was
 6        accredited by the Council on  Academic  Accreditation  in
 7        Audiology  and  Speech-Language Pathology of the American
 8        Speech-Language-Hearing Association or its predecessor.
 9             (3)  Either (i) has completed  a  program  of  study
10        before  July  1,  2002  that  includes  course  work  and
11        supervised  clinical experience sufficient in breadth and
12        depth to demonstrate knowledge and skills related to  the
13        specific  problems,  methods and procedures applicable to
14        students with disabilities in a  school  setting  serving
15        ages  3  through  21  or  (ii)  meets  the  content  area
16        standards for speech-language pathologists adopted by the
17        State  Board of Education, in consultation with the State
18        Teachers Certification Board.
19             (4)  Has   successfully   completed   the   required
20        Illinois certification tests.
21             (5)  Has  paid  the  application  fee  required  for
22        certification.
23        The provisions of this subsection (b) do not preclude the
24    issuance of  a  teaching  certificate  to  a  speech-language
25    pathologist who qualifies for such a certificate.

27        Section  10.   The Illinois Speech-Language Pathology and
28    Audiology Practice Act is amended by changing Section  7  and
29    adding Section 8.1 as follows:

31        (Section scheduled to be repealed on January 1, 2008)
32        Sec. 7. Licensure requirement.

 1        (a)  Except  as  provided  in subsection (b), on or after
 2    June  1,  1989,  no  person  shall  practice  speech-language
 3    pathology  or  audiology  without  first  applying  for   and
 4    obtaining  a  license  for  such purpose from the Department.
 5    Except as provided in this Section, on or  after  January  1,
 6    2002,  no  person shall perform the functions and duties of a
 7    speech-language pathology assistant  without  first  applying
 8    for  and  obtaining  a  license  for  that  purpose  from the
 9    Department.
10        (b)  A person  holding  a  regular  license  to  practice
11    speech-language  pathology  or  audiology  under  the laws of
12    another state, a territory  of  the  United  States,  or  the
13    District   of  Columbia  who  has  made  application  to  the
14    Department  for  a  license   to   practice   speech-language
15    pathology or audiology may practice speech-language pathology
16    or  audiology  without a license for 90 days from the date of
17    application or until disposition of the  license  application
18    by  the  Department,  whichever  is sooner, if the person (i)
19    holds a Certificate of Clinical Competence from the  American
20    Speech-Language-Hearing    Association   in   speech-language
21    pathology or audiology or, in the case of an  audiologist,  a
22    certificate from the American Board of Audiology and (ii) has
23    not  been disciplined and has no disciplinary matters pending
24    in a state, a territory, or the District of Columbia.

28        Sec. 8.1. Temporary license.  On  and  after  January  1,
29    2004,  a  person  who  has  met the requirements of items (a)
30    through (e) of Section 8 and intends to undertake  supervised
31    professional  experience as a speech-language pathologist, as
32    required by subsection (f) of Section 8 and the rules adopted
33    by the Department, must first obtain a temporary license from

 1    the Department. A temporary license  may  be  issued  by  the
 2    Department  only  to  an  applicant  pursuing  licensure as a
 3    speech-language  pathologist  in  this  State.  A   temporary
 4    license  shall  be issued to an applicant upon receipt of the
 5    required fee as set forth by rule and documentation on  forms
 6    prescribed  by  the  Department demonstrating that a licensed
 7    speech-language  pathologist  has  agreed  to  supervise  the
 8    professional experience of the applicant. A temporary license
 9    shall be issued for a period of 12 months and may be  renewed
10    only once for good cause shown.

11        Section  99.  Effective  date.   This Act takes effect on
12    January 1, 2004.".
