SYNOPSIS AS INTRODUCED:
 
20 ILCS 1305/10-80 new

    Amends the Department of Human Services Act. Provides that subject to appropriation, the Department of Human Services shall establish and administer a program that provides parents or guardians of children enrolled in a qualifying day care facility reimbursements of paid child care expenses for up to 5 sick days each calendar year. Provides that the reimbursement rate for sick days shall be determined by the Department by rule. Requires claims for reimbursement to be made to the Department by the qualifying day care facility on behalf of a parent or guardian who submits a receipt and any other required documentation that demonstrates the parent or guardian has satisfied all payment obligations for the claimed sick day. Provides that upon the Department's determination that reimbursement is proper, a reimbursement shall be made to the qualifying day care facility which shall then credit the parent or guardian the reimbursement amount. Provides that parents and guardians and any other relatives who receive child care assistance under the Department's Child Care Assistance Program are not eligible for sick day reimbursements under the amendatory Act.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Human Services Act is amended
5by adding Section 10-80 as follows:
 
6    (20 ILCS 1305/10-80 new)
7    Sec. 10-80. Day care reimbursement for sick days.
8    (a) As used in this Section, "qualifying day care
9facility" means a day care center, day care home, or group day
10care home licensed under the Child Care Act of 1969.
11    (b) Subject to appropriation, the Department of Human
12Services shall establish and administer a program that
13provides parents or guardians of children enrolled in a
14qualifying day care facility reimbursements of paid child care
15expenses for up to 5 sick days each calendar year. The
16reimbursement rate for sick days shall be determined by the
17Department by rule. Claims for reimbursement shall be made to
18the Department by the qualifying day care facility on behalf
19of a parent or guardian who submits a receipt and any other
20required documentation that demonstrates the parent or
21guardian has satisfied all payment obligations for the claimed
22sick day. Upon the Department's determination that
23reimbursement is proper, a reimbursement shall be made to the

2parent or guardian the reimbursement amount. Parents and
3guardians and any other relatives who receive child care
4assistance under Section 9A-11 of the Illinois Public Aid Code
5are not eligible for a reimbursement under this Section. The
6Department may adopt any rules necessary to implement this
7Section.
