SYNOPSIS AS INTRODUCED:

    Amends the Gubernatorial Boards and Commissions Act. Provides that a person is ineligible for appointment or reappointment to any board or commission for a term of office beginning on or after the effective date of the amendatory Act, if the person is a spouse, child, or spouse of a child of a State official or is a party to a civil union with a State official. Amends the Civil Administrative Code of Illinois. Provides that a person is ineligible for appointment or reappointment as the head officer of a department of State government for a term of office beginning on or after the effective date of the amendatory Act, if the person is a spouse, child, or spouse of a child of a State official or is a party to a civil union with a State official. Defines "State official" and "party to a civil union".

A BILL FOR

1     AN ACT concerning State government.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Gubernatorial Boards and Commissions Act is
5 amended by adding Section 17 as follows:

6     (15 ILCS 50/17 new)
7     Sec. 17. Eligibility for appointment or reappointment to a
8 board or commission. A person is ineligible for appointment or
9 reappointment to any board or commission for a term of office
10 beginning on or after the effective date of this amendatory Act
11 of the 98th General Assembly, if the person is a spouse, child,
12 or spouse of a child of a State official or is a party to a
13 civil union with a State official. For the purposes of this
14 Section, "State official" has the meaning established in
15 subsection (c) of Section 2 of the Lobbyist Registration Act,
16 and "party to a civil union" has the meaning established in
17 Section 10 of the Illinois Religious Freedom Protection and
18 Civil Union Act.

19     Section 10. The Civil Administrative Code of Illinois is
20 amended by changing Section 5-20 as follows:

1     Sec. 5-20. Heads of departments.
2     (a)Each department shall have an officer as its head who
3 shall be known as director or secretary and who shall, subject
4 to the provisions of the Civil Administrative Code of Illinois,
5 execute the powers and discharge the duties vested by law in
6 his or her respective department.
7     The following officers are hereby created:
8     Director of Aging, for the Department on Aging.
9     Director of Agriculture, for the Department of
10 Agriculture.
11     Director of Central Management Services, for the
12 Department of Central Management Services.
13     Director of Children and Family Services, for the
14 Department of Children and Family Services.
15     Director of Commerce and Economic Opportunity, for the
16 Department of Commerce and Economic Opportunity.
17     Director of Corrections, for the Department of
18 Corrections.
19     Director of the Illinois Emergency Management Agency, for
20 the Illinois Emergency Management Agency.
21     Director of Employment Security, for the Department of
22 Employment Security.
23     Secretary of Financial and Professional Regulation, for
24 the Department of Financial and Professional Regulation.
25     Director of Healthcare and Family Services, for the
26 Department of Healthcare and Family Services.

1     Director of Human Rights, for the Department of Human
2 Rights.
3     Secretary of Human Services, for the Department of Human
4 Services.
5     Director of Juvenile Justice, for the Department of
6 Juvenile Justice.
7     Director of Labor, for the Department of Labor.
8     Director of Natural Resources, for the Department of
9 Natural Resources.
10     Director of Public Health, for the Department of Public
11 Health.
12     Director of Revenue, for the Department of Revenue.
13     Director of State Police, for the Department of State
14 Police.
15     Secretary of Transportation, for the Department of
16 Transportation.
17     Director of Veterans' Affairs, for the Department of
18 Veterans' Affairs.
19     (b) A person is ineligible for appointment or reappointment
20 as the head officer of a department for a term of office
21 beginning on or after the effective date of this amendatory Act
22 of the 98th General Assembly, if the person is a spouse, child,
23 or spouse of a child of a State official or is a party to a
24 civil union with a State official. For the purposes of this
25 Section, "State official" has the meaning established in
26 subsection (c) of Section 2 of the Lobbyist Registration Act,
