SYNOPSIS AS INTRODUCED:

    Amends the Gubernatorial Boards and Commissions Act. Provides that a person is ineligible for appointment or reappointment to any board or commission for a term of office beginning on or after the effective date of the amendatory Act, if the person is a spouse, child, or spouse of a child of a State official or is a party to a civil union with a State official. Amends the Civil Administrative Code of Illinois. Provides that a person is ineligible for appointment or reappointment as the head officer of a department of State government for a term of office beginning on or after the effective date of the amendatory Act, if the person is a spouse, child, or spouse of a child of a State official or is a party to a civil union with a State official. Defines "State official" and "party to a civil union".

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Gubernatorial Boards and Commissions Act is
5amended by adding Section 17 as follows:
 
6    (15 ILCS 50/17 new)
7    Sec. 17. Eligibility for appointment or reappointment to a
8board or commission. A person is ineligible for appointment or
9reappointment to any board or commission for a term of office
10beginning on or after the effective date of this amendatory Act
11of the 98th General Assembly, if the person is a spouse, child,
12or spouse of a child of a State official or is a party to a
13civil union with a State official. For the purposes of this
14Section, "State official" has the meaning established in
15subsection (c) of Section 2 of the Lobbyist Registration Act,
16and "party to a civil union" has the meaning established in
17Section 10 of the Illinois Religious Freedom Protection and
18Civil Union Act.
 
19    Section 10. The Civil Administrative Code of Illinois is
20amended by changing Section 5-20 as follows:

1    Sec. 5-20. Heads of departments.
2    (a) Each department shall have an officer as its head who
3shall be known as director or secretary and who shall, subject
4to the provisions of the Civil Administrative Code of Illinois,
5execute the powers and discharge the duties vested by law in
6his or her respective department.
7    The following officers are hereby created:
8    Director of Aging, for the Department on Aging.
9    Director of Agriculture, for the Department of
10Agriculture.
11    Director of Central Management Services, for the
12Department of Central Management Services.
13    Director of Children and Family Services, for the
14Department of Children and Family Services.
15    Director of Commerce and Economic Opportunity, for the
16Department of Commerce and Economic Opportunity.
17    Director of Corrections, for the Department of
18Corrections.
19    Director of the Illinois Emergency Management Agency, for
20the Illinois Emergency Management Agency.
21    Director of Employment Security, for the Department of
22Employment Security.
23    Secretary of Financial and Professional Regulation, for
24the Department of Financial and Professional Regulation.
25    Director of Healthcare and Family Services, for the
26Department of Healthcare and Family Services.

1    Director of Human Rights, for the Department of Human

3    Secretary of Human Services, for the Department of Human
