SYNOPSIS AS INTRODUCED:
 
30 ILCS 605/8.5 new

    Amends the State Property Control Act. Provides that the Director of the Department of Central Management Services may sell the Thomson Correctional Center and the property on which it is located to the federal government for a reasonable price. Defines "reasonable price". Provides that the Thomson Correctional Center and the land on which it is located may not be sold to any other party by the administrator or by any other State officer or agency, unless it has first been offered for sale to the federal government. Authorizes the Director of Central Management Services to enter into any agreements and execute any documents necessary to sell the Thomson Correctional Center and the property on which it is located. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Property Control Act is amended by
5adding Section 8.5 as follows:
 
6    (30 ILCS 605/8.5 new)
7    Sec. 8.5. Thomson Correctional Center.
8    (a) It is the intent of the General Assembly that the
9authority granted to the Governor by this amendatory Act of the
1097th General Assembly is for the purpose of facilitating a net
11increase in the number of persons employed in Illinois,
12especially persons employed (i) in a position with
13employment-related benefits including, but not limited to,
14health care benefits and (ii) at a former State facility that
15is sold as a result of this amendatory Act of the 97th General
16Assembly.
17    (b) Notwithstanding any other provision of this Act or any
18other law to the contrary, the administrator is authorized
19under this Section to sell the Thomson Correctional Center and
20the property on which it is located to the federal government
21for a reasonable price. For the purposes of this subsection
22(b), "reasonable price" means an amount of money approved in
23writing by the Governor that the Governor, in his or her

1discretion, determines is advantageous to the State
2considering the general economic conditions of the State, the
3short-term and long-term costs to the State of maintaining the
4property, and the State's ability to productively use the
5property.
6    (c) The Thomson Correctional Center and the land on which
7it is located may not be sold to any other party by the
8administrator or by any other State officer or agency, unless
9it has first been offered for sale to the federal government as
10provided in subsection (b).
11    (d) The administrator is authorized to enter into any
12agreements and execute any documents necessary to exercise the
13authority granted by this Section.
14    (e) The moneys received from the sale of property under
15this Section shall be used to satisfy the State debt related to
16the Thomson Correctional Center. After satisfying that debt,
17the balance of the moneys received from the sale of property
18under this Section shall be deposited into the General Revenue
19Fund.
20    (f) The provisions of this Section apply and control
21notwithstanding any other provision of this Act or any other
22law to the contrary.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
