SYNOPSIS AS INTRODUCED:

65 ILCS 5/3.1-40-65 new

Amends the Illinois Municipal Code. Provides that any proposal for the expenditure of municipal funds on a charitable or non-profit organization shall be listed as a separate item on the council's agenda. Sets forth requirements concerning notice. Limits the concurrent exercise of home rule powers. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 3.1-40-65 as follows:

(65 ILCS 5/3.1-40-65 new)

Sec. 3.1-40-65. Charitable spending. Any proposal for the expenditure of municipal funds on a charitable or non-profit organization by the municipality shall be listed as a separate item on the city council's agenda. Notice of the meeting where the proposal will be heard shall be published in a newspaper of general circulation within the municipality at least 10 days before the meeting. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule municipalities of powers and functions exercised by the State.

Section 99. Effective date. This Act takes effect upon becoming law.
