 1        AN ACT relating to education.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The School Code is amended by  adding  Section
 5    2-3.131 as follows:

 6        (105 ILCS 5/2-3.131 new)
 7        Sec.   2-3.131.  Special   education  teacher  incentives
 8    program.
 9        (a)  As used in this Section, the term "special education
10    program"  means  a  program  provided  for   those   children
11    described in Sections 14-1.02 and 14-1.03a of this Code.
12        (b)  The  State  Board  of  Education  shall  establish a
13    program to provide monetary incentives to  teachers  who  are
14    certified  pursuant  to  Section  14-9.01  of  this  Code. To
15    receive a monetary incentive under this  program,  a  teacher
16    shall  contract with the State Board of Education to teach in
17    a special education program in a school district for 3 school
18    years. The amount of the incentive shall be as follows:
19             (1)  $3,000 after completion  of  the  first  school
20        year   in   the  program,  contingent  upon  the  teacher
21        receiving a satisfactory or better rating when  evaluated
22        under Article 24A of this Code.
23             (2)  $3,000  after  completion  of the second school
24        year  in  the  program,  contingent  upon   the   teacher
25        receiving  a satisfactory or better rating when evaluated
26        under Article 24A of this Code.
27             (3)  $4,000 after completion  of  the  third  school
28        year   in   the  program,  contingent  upon  the  teacher
29        receiving a satisfactory or better rating when  evaluated
30        under Article 24A of this Code.
31        (c)  Unless  occasioned  by  death or total and permanent

 1    disability, the failure of a teacher to complete all or  part
 2    of  his  or  her commitment under this Section shall obligate
 3    the teacher  to  proportionately  repay  the  amount  of  the
 4    incentive provided, plus 5% interest on that amount.
 5        (d)  The  State  Board  of  Education may adopt any rules
 6    necessary to implement this Section.
