Synopsis As Introduced
Amends the Criminal Code of 1961 and the Unified Code of Corrections. Provides that a person convicted of financial exploitation of an elderly person or a person with a disability shall be sentenced to a minimum term of imprisonment of one year for a Class 4 felony violation, 2 years for a Class 3 felony violation, 3 years for a Class 2 felony violation, and 4 years for a Class 1 felony violation.

Adds reference to:
730 ILCS 5/5-5-3.2from Ch. 38, par. 1005-5-3.2

Replaces everything after the enacting clause. Amends the Unified Code of Corrections. Provides that the court may consider the commission of the offense of financial exploitation of an elderly person or a person with a disability as an aggravating factor in sentencing.

Senate Floor Amendment No. 1
Deletes the substance of the bill. Amends the Unified Code of Corrections. Provides that it is an aggravating factor in sentencing that the defendant committed the offense against a person who was elderly, disabled, or infirm by taking advantage of a family or fiduciary relationship with the elderly, disabled, or infirm person.
