    AN ACT concerning State government.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Department of Transportation Law of the
Civil Administrative Code of Illinois is amended by changing
Section 2705-575 as follows:

    Sec. 2705-575. Sale of used vehicles. Whenever the
Department has deemed a shall replace any used vehicle shall be
replaced, it shall notify the Division of Property Control of
the Department of Central Management Services and the Division
of Vehicles of the Department of Central Management Services
for potential reallocation of the vehicle to another State
agency through inter-agency transfer per standard fleet
vehicle allocation procedures. If the vehicle is not
re-allocated for use into the State fleet or agencies by the
Division of Property Control or the Division of Vehicles of the
Department of Central Management Services, the and give units
of local government in this State and the Department of Natural
Resources the first opportunity to purchase the vehicle. The
Department shall make the vehicle available to be required to
notify only the Department of Natural Resources and those units
of local government that have previously requested the
notification and provide them the opportunity to purchase the
vehicle through a sealed bid sale. Any proceeds from the sale
of the vehicles to units of local government shall be deposited
in the Road Fund. The term "vehicle" as used in this Section is
defined to include passenger automobiles, light duty trucks,
and heavy duty trucks, and other self-propelled motorized
equipment (in excess of 25 horse-power) and attachments.

    Section 99. Effective date. This Act takes effect January
1, 2012.
