CIV PRO-MED MALPRACTICE-SANCTN

Synopsis of Bill as introduced:
Amends the Civil Practice Article of the Code of Civil Procedure.
In the Section concerning pleading in healing art malpractice cases,
adds a provision that the court may impose sanctions against a party
or attorney if it determines that there has been a willful failure to
comply with the requirements of the Section or that the action is
frivolous or otherwise not commenced in good faith. Provides that
appropriate sanctions include a bar against presenting a claim or
defense and an order to pay damages and costs. Effective immediately.
FISCAL NOTE (Office of the Illinois Courts)
Based on a review of the bill, it has been determined that
House Bill 679 would have no fiscal impact on the judicial
          branch.
JUDICIAL NOTE (Office of the Illinois Courts)
Based on a review of the bill, it has been determined that
House Bill 679 would neither increase nor decrease the number
of judges needed in the State.
