HENDON-TROTTER-LIGHTFORD.

(GARRETT-HOWARD-YARBROUGH-YOUNGE-KENNER)

   205 ILCS 690/12 new                                                         
   205 ILCS 690/30                                                             
   205 ILCS 690/36                                                             

        Amends the Check Printer  and  Check  Number  Act.   Prohibits  a      
   financial  institution  from distributing temporary checks in response      
   to a request made by telephone.  Provides that a financial institution      
   may distribute temporary checks only to an  account  holder  and  only      
   after the account holder provides written documentation of the account      
   number.   Authorizes  the  Commissioner  of  Banks  and Real Estate to      
   impose a civil penalty not exceeding $10,000 per violation.   Provides      
   that a violation constitutes a Class A misdemeanor.                         
        SENATE AMENDMENT NO. 1.                                                
          Deletes reference to:                                                
          205 ILCS 690/12 new                                                  
          205 ILCS 690/30                                                      
          205 ILCS 690/36                                                      
          Adds reference to:                                                   
          720 ILCS 5/17-1                 from Ch. 38, par. 17-1               
        Deletes everything. Amends the Criminal Code of 1961. Provides         
   that a person who, with the intent to obtain access to funds of             
   another person, makes a false statement or a misrepresentation to the       
   financial institution, or who possesses, transfers, negotiates, or          
   presents for payment a check or draft to the financial institution          
   with the knowledge that such possession, transfer, negotiation, or          
   presentment is not authorized by the account holder or the issuing          
   financial institution is guilty of a Class A misdemeanor.

          SB 1713 would have no fiscal impact on the judicial branch.          
          JUDICIAL NOTE (Illinois Courts Administrative Office)                
          SB 1713 would neither increase nor decrease the number of            
          judges needed in the State.
