(WATSON)

   235 ILCS 5/3-12           from Ch. 43, par. 108                             

        Amends the Liquor Control Act of 1934. Provides that the Illinois      
   Liquor Control Commission may appoint, at the Commission's discretion,      
   hearing officers.  Effective immediately.                                   
          FISCAL NOTE (Liquor Control Commission)                              
          There would be no appreciable impact on revenues from HB 5000.       
          Total estimated cost per hearing would be $965, including costs      
          of a hearing officer, court reporter and transcript, and             
          travel. The City of Chicago reports a total of $245,750 in           
          FY '01 for hearings conducted approximately 4 days per week.         
        SENATE AMENDMENT NO. 1. (Tabled May 8, 2002)                           
        Provides that the hearing  officers  may  be  appointed  only  to      
   conduct  hearings involving complex issues or issues that will require      
   a protracted period of time to resolve.                                     
        SENATE AMENDMENT NO. 2. (Tabled May 8, 2002)                           
          Adds reference to:                                                   
          235 ILCS 5/6-11                 from Ch. 43, par. 127                
        Further amends the Liquor Control Act  of  1934.  Authorizes  the      
   issuance  of  a  license to sell alcoholic liquor at retail on certain      
   premises within 100 feet  of  a  church  or  school  if  there  was  a      
   preexisting license authorizing the sale of alcoholic liquor at retail      
   at  the  premises  and  if  the  premises  are not located in Chicago.      
   Authorizes a church or church affiliated school located in a home rule      
   municipality to locate within 100 feet of a property for  which  there      
   is  a  preexisting license authorizing the sale of alcoholic liquor at      
   retail.                                                                     
        SENATE AMENDMENT NO. 3.                                                
        Combines the original bill and the adopted amendments. Removes         
   the exemption for the issuance of a new retail liquor license if (i)        
   immediately prior to the issuance of the license, the occupant of the       
   premises held a license authorizing the sale of alcoholic liquor at         
   the premises and (ii) the premises are not located in Chicago.              
   Effective immediately.
