 1        AN ACT in relation to alcohol, amending named Acts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Department of Public  Health  Powers  and
 5    Duties  Law  of  the Civil Administrative Code of Illinois is
 6    amended by adding Section 2310-585 as follows:

 8        Sec. 2310-585.  To inspect the premises of a retailer who
 9    sells alcoholic beverages for consumption on the premises and
10    to enforce the requirement that such retailers post signs  as
11    required  under  Section  6-32  of  the Liquor Control Act of
12    1934.

13        Section 10.  The Liquor Control Act of 1934 is amended by
14    adding Section 6-32 as follow:

15        (235 ILCS 5/6-32 new)
16        Sec. 6-32.  Warning signs.
17        (a)  A  retailer  who  sells  alcoholic   beverages   for
18    consumption  on  the  premises  shall  post, in a conspicuous
19    place,  a  sign  that  clearly  reads:   "Warning:   Drinking
20    alcoholic  beverages  during  pregnancy   can   cause   birth
21    defects."   The  sign  shall include a picture, occupying not
22    less than one-half of the sign, illustrating a pregnant woman
23    and  the  international  red  "prohibited"  symbol  over   an
24    alcoholic beverage. The illustration shall be no smaller than
25    11 inches by 17 inches.
26        (b)  The   Department   shall  make  such  warning  signs
27    available to  retailers  of  alcoholic  beverages  and  shall
28    promulgate  rules with respect to the form and the posting of
29    such signs.  A fee may be charged by the Department to  cover

 1    printing, postage, and handling expenses.
 2        (c)  A  person  who  fails or refuses to post the sign as
 3    required in this  Section  shall  be  guilty  of  a  Class  C
 4    misdemeanor.  A person who violates subsection (a) shall also
 5    be  liable  for  a civil fine in an amount not to exceed $150
 6    for the first violation or $500 for  a  second  violation  or
 7    subsequent   violation.   Such  fine  shall  be  imposed  and
 8    collected by the Department of Public Health after  providing
 9    the person with due process and an opportunity to be heard.
