 1                    AMENDMENT TO SENATE BILL 1175

 2        AMENDMENT NO.     .  Amend Senate Bill 1175 by  replacing
 3    lines  31 through 34 on page 4 and lines 1 through 11 on page
 4    5 with the following:
 5        "(4)  The findings and recommended order of  the  hearing
 6    officer shall be filed with the Commission.  The findings and
 7    recommended  order  may  need  not  be  authored by a hearing
 8    officer other than the hearing officer who  presides  at  the
 9    public hearing if:
10             (a)  the  hearing officer who presides at the public
11        hearing is unable to author the findings and  recommended
12        order  by reason of death, disability, or separation from
13        employment; and
14             (b) (a)  all parties to a  complaint  file  a  joint
15        motion   agreeing   agree   to   have  the  findings  and
16        recommended order decision written by a  hearing  officer
17        who did not preside at the public hearing.;
18             (b)  the  presiding hearing officer transmits his or
19        her impression of  witness  credibility  to  the  hearing
20        officer  who  authors the findings and recommended order;
21        and
22             (c) there are no questions  of  witness  credibility
23        presented  by  the  record  as  found  by  the  presiding
24        officer."; and

 1    on  page  10,  by  replacing  lines  2  through  16  with the
 2    following:
 3        "(4)  The findings and recommended order of  the  hearing

 6    officer other than the hearing officer who  presides  at  the
 7    public hearing if:
