 1                    AMENDMENT TO SENATE BILL 884

 2        AMENDMENT NO.     .  Amend Senate Bill 884  by  replacing
 3    the title with the following:
 4        "AN ACT in relation to public aid."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 5.  The State Finance Act is amended  by  adding
 8    Section 5.545 as follows:

 9        (30 ILCS 105/5.545 new)
10        Sec. 5.545.  The Medical Special Purposes Trust Fund.

11        Section  10.  The  Illinois Public Aid Code is amended by
12    changing Sections 12-4.18  and  12-4.19  and  adding  Section
13    12-10.5 as follows:

14        (305 ILCS 5/12-4.18) (from Ch. 23, par. 12-4.18)
15        Sec.  12-4.18.  Grants  and  gifts  for  public  aid  and
16    related  welfare  purposes.  Accept,  hold  and administer in
17    behalf of the State any  grant,  gift  or  legacy  of  money,
18    securities,  or property to the Illinois Department or to the
19    State of Illinois for  public  aid  or  any  related  welfare

 1    purpose.
 2        From  appropriations  from the Assistance to the Homeless
 3    Fund, a special fund in the State treasury, which  is  hereby
 4    created,  provide  grants to not-for-profit organizations for
 5    the purpose of providing assistance to homeless persons.
 6        Grants, gifts, and legacies for employment  and  training
 7    programs  for  public  assistance  clients shall be deposited
 8    into the Employment and Training Fund.
 9        Grants, gifts,  donations,  and  legacies  for  functions
10    connected  with  the  administration  of  any medical program
11    administered by the Illinois Department  shall  be  deposited
12    into  the  Medical  Special Purposes Trust Fund created under
13    Section 12-10.5.

16        Sec. 12-4.19. Grants for Pilot Studies and Research.
17        Co-operate   with   the   Federal   Government,   private
18    foundations, persons, corporations or other  entities  making
19    grants  of  funds  or  offering  the  services  of  technical
20    assistants  for  pilot  studies  and  other research programs
21    relating  to  effective  methods  of  rehabilitation  or  the
22    adequacy of public aid and  welfare  programs,  policies  and
23    procedures,  and  accept,  hold and administer grants made in
24    connection therewith. Grants for functions connected with the
25    administration of any medical  program  administered  by  the
26    Illinois  Department  shall  be  deposited  into  the Medical
27    Special Purposes Trust Fund created under Section 12-10.5.

30        Sec. 12-10.5.  Medical Special Purposes Trust Fund.
31        (a)  The Medical Special Purposes Trust Fund ("the Fund")
32    is created.  Any grant, gift, donation, or legacy of money or

 1    securities that the Department of Public Aid is authorized to
 2    receive under Section 12-4.18 or Section 12-4.19, and that is
 3    dedicated for functions connected with the administration  of
 4    any  medical program administered by the Department, shall be
 5    deposited into the Fund.  All federal moneys received by  the
 6    Department  as  reimbursement for disbursements authorized to
 7    be made from the Fund shall also be deposited into the Fund.
 8        (b)  No moneys received from  a  service  provider  or  a
 9    governmental  or  private  entity  that  is enrolled with the
10    Department  as  a  provider  of  medical  services  shall  be
11    deposited into the Fund.
12        (c)  Disbursements may be made  from  the  Fund  for  the
13    purposes  connected  with  the  grants,  gifts, donations, or
14    legacies deposited into the Fund, including, but not  limited
15    to,   medical   quality   assessment   projects,  eligibility
16    population studies, medical information systems  evaluations,
17    and other administrative functions that assist the Department
18    in  fulfilling  its  health  care  mission under the Illinois
19    Public Aid Code and the Children's Health  Insurance  Program
20    Act.

21        Section  99.  Effective  date.   This Act takes effect on
22    July 1, 2001.".
