 1        AN ACT in relation to counties.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Counties Code is amended by adding Section
 5    3-6040 as follows:

 6        (55 ILCS 5/3-6040 new)
 7        Sec. 3-6040.  Company for the apprehension  of  criminals
 8    and  the  recovery  of  stolen property.  There is within the
 9    Office of the Will County Sheriff a company of  at  least  20
10    citizens   organized   for   the  purpose  of  detecting  and
11    apprehending criminals against  the  laws  of  the  State  of
12    Illinois.  The company shall be a continuation of the company
13    formed  in  Will  County  under  "An  Act  to  authorize  the
14    formation  of companies for the detection and apprehension of
15    horse thieves and other  felons",  filed  July  7,  1885,  as
16    amended.  Any action taken by that company in accordance with
17    that  Act as that Act existed before its repeal by Public Act
18    76-754 is validated. The company shall have power to call  to
19    its  aid the peace officers of Will County in accordance with
20    law in the pursuit and  apprehension  of  criminals  and  the
21    recovery  of  stolen  property.  The  company  may add to its
22    number or expel members. At a regular meeting of the company,
23    the company may elect from its membership  no  more  than  20
24    members  to  be  recommended  to  the Will County Sheriff for
25    appointment as deputy sheriffs.  These 20 members so selected
26    shall be eligible upon a finding that they have previously or
27    currently met the requirements of Section 8.1 or 8.2  of  the
28    Illinois  Police  Training  Act  for  certification as police
29    officers.  In case of a vacancy or vacancies  on  account  of
30    the  death,  removal, or resignation of any member so elected
31    and appointed as a deputy sheriff, the company may elect  and

 1    recommend  another  member or members for appointment to fill
 2    the vacancy or vacancies.

 3        Section 99. Effective date. This Act  takes  effect  upon
 4    becoming law.
