 1                    AMENDMENT TO SENATE BILL 633

 2        AMENDMENT NO.     .  Amend Senate Bill 633  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The Acupuncture Practice Act is amended by
 5    adding Section 20.1 and changing Section 50 as follows:

 6        (225 ILCS 2/20.1 new)
 7        Sec.  20.1.   Guest  instructors  of  acupuncture.    The
 8    provisions  of this Act do not prohibit an acupuncturist from
 9    another State or country, who is not licensed under this  Act
10    and  who  is  an  invited guest of a professional acupuncture
11    association  or  scientific  acupuncture  foundation  or   an
12    acupuncture training program or continuing education provider
13    that   is   approved   under   this  Act,  from  engaging  in
14    professional  education   through   lectures,   clinics,   or
15    demonstrations.   To   qualify   as  a  guest  instructor  of
16    acupuncture, the acupuncturist must have been issued a  guest
17    instructor  of  acupuncture  permit  by  the Department.  The
18    Department shall grant  a  guest  instructor  of  acupuncture
19    permit  if  the  Department determines that the applicant for
20    the permit (i) is currently certified in good standing as  an
21    acupuncturist  by  the  National Certification Commission for
22    Acupuncture and Oriental Medicine;  or  (ii)  has  sufficient

 1    training  to qualify as a licensed acupuncturist in Illinois.
 2    By rule, the Department may prescribe  forms  that  shall  be
 3    used to apply for guest instructor of acupuncture permits and
 4    charge  an  application  fee  to defray expenses borne by the
 5    Department  in  connection  with   implementation   of   this
 6    amendatory  Act  of the 92nd General Assembly.  The applicant
 7    shall submit his or her application for a guest instructor of
 8    acupuncture permit to the Department.  The  Department  shall
 9    issue  a  guest instructor of acupuncture permit, or indicate
10    why the Department has refused to issue the permit, within 60
11    days after the application is complete and on file  with  the
12    Department.   The  Department  shall  maintain  a registry of
13    guest instructors of acupuncture.    A  guest  instructor  of
14    acupuncture  permit  shall  be valid for 12 months. The guest
15    instructor of acupuncture may engage in  the  application  of
16    acupuncture  techniques  in  conjunction  with  the lectures,
17    clinics, or demonstrations for a maximum of  12  months,  but
18    may  not  open  an  office,  appoint  a place to meet private
19    patients, consult with private patients, or otherwise  engage
20    in  the  practice  of  acupuncture beyond what is required in
21    conjunction with these lectures, clinics, or demonstrations.

23        Sec. 50.  Practice prohibited.  Unless he or she has been
24    issued, by the Department, a valid, existing  license  as  an
25    acupuncturist under this Act, no person may use the title and
26    designation  of  "Acupuncturist",  "Licensed  Acupuncturist",
27    "Certified  Acupuncturist",  "C.A.",  "Act.", "Lic. Act.", or
28    "Lic. Ac." either directly or indirectly, in connection  with
29    his  or her profession or business.  No person licensed under
30    this Act may  use  the  designation  "medical",  directly  or
31    indirectly,  in  connection  with  his  or  her profession or
32    business.  Nothing shall prevent a physician from  using  the
33    designation "Acupuncturist".

 1        No  person  may  practice,  offer to practice, attempt to
 2    practice, or hold himself or herself out  to  practice  as  a
 3    licensed acupuncturist without being licensed under this Act.
 4        This  Act  does  not  prohibit  a  person  from  applying
 5    acupuncture  techniques  as  part  of  his or her educational
 6    training when he or she:
 7             (1)  is  engaged  in  a  State-approved  course   in
 8        acupuncture, as provided in this Act;
 9             (2)  is  a  graduate  of a school of acupuncture and
10        participating in a postgraduate training program;
11             (3)  is a graduate of a school  of  acupuncture  and
12        participating  in  a  review  course  in  preparation for
13        taking  the   National   Certification   Commission   for
14        Acupuncture and Oriental Medicine examination; or
15             (4)  is participating in a State-approved continuing
16        education   course   offered   through  a  State-approved
17        provider.
18        Students   attending   schools   of   acupuncture,    and
19    professional acupuncturists who are not licensed in Illinois,
20    may  engage  in the application of acupuncture  techniques in
21    conjunction with their education as provided in this Act, but
22    may not open an office,  appoint  a  place  to  meet  private
23    patients,  consult with private patients, or otherwise engage
24    in the practice of acupuncture beyond  what  is  required  in
25    conjunction with their education.

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.".
