 1        AN ACT in relation to criminal law.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section   5.   The Unified Code of Corrections is amended
 5    by changing Section 3-15-3 as follows:

 6        (730 ILCS 5/3-15-3) (from Ch. 38, par. 1003-15-3)
 7        Sec.   3-15-3.  Persons   with   mental    illness    and
 8    developmental disabilities.
 9        (a)  The   Department   must,   may  by  rule,  establish
10    standards and procedures for the provision of  mental  health
11    and  developmental disability services to persons with mental
12    illness and persons with a developmental disability  confined
13    in  a  local jail or juvenile detention facility as set forth
14    under Section 3-7-7 of this Code.
15        Those    standards    must    address    screening    and
16    classification, the use of psychotropic medications,  suicide
17    prevention,  qualifications  of staff, staffing levels, staff
18    training,   discharge,    linkage    and    aftercare,    the
19    confidentiality  of  mental  health  records,  and such other
20    issues as are necessary to insure that  inmates  with  mental
21    illness receive adequate and humane care and services.
22        (b)  At least once each year, the Department must inspect
23    each   local   jail   and  juvenile  detention  facility  for
24    compliance with the standards established. The results of the
25    inspection must be  made  available  by  the  Department  for
26    public  inspection.   If any jail or facility does not comply
27    with the standards established, the Director  of  Corrections
28    must  give notice to the county board and the sheriff of such
29    noncompliance, specifying the particular standards that  have
30    not  been  met  by  the  jail  or  facility.   If the jail or
31    facility is not in  compliance  with  the  standards  when  6

 1    months  have  elapsed  from  the  giving  of such notice, the
 2    Director of Corrections may petition  the  appropriate  court
 3    for  an  order  requiring Jail or facility to comply with the
 4    standards  established  by  the  Department  or   for   other
 5    appropriate relief.
