 1        AN ACT in relation to firearms.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5. The Firearm Owners Identification Card Act is
 5    amended by changing Section 3.1 as follows:

 6        (430 ILCS 65/3.1) (from Ch. 38, par. 83-3.1)
 7        Sec.  3.1. Dial up system. The Department of State Police
 8    must shall provide a dial up telephone system that must which
 9    shall be used by any federally licensed firearm dealer who is
10    to transfer a firearm under the provisions of this Act and by
11    any other dealer, whether or  not  licensed  under  Title  18
12    United  States  Code,  Section  923,  who  sells,  gives,  or
13    otherwise  transfers  a firearm at a gun show. The Department
14    of State Police must shall utilize existing  technology  that
15    which allows the caller to be charged a fee equivalent to the
16    cost  of  providing  this service but not to exceed $2.  Fees
17    collected by the Department of State  Police  must  shall  be
18    deposited  in  the  State  Police  Services  Fund and used to
19    provide the service.
20        Upon  receiving  a  request  from  a  federally  licensed
21    firearm dealer or  other  dealer,  the  Department  of  State
22    Police  must  shall  immediately  approve, or within the time
23    period established by Section 24-3 of the  Criminal  Code  of
24    1961 regarding the delivery of firearms, notify the inquiring
25    dealer  of any objection that would disqualify the transferee
26    from acquiring or possessing a  firearm.  In  conducting  the
27    inquiry,  the  Department of State Police must shall initiate
28    and complete an automated  search  of  its  criminal  history
29    record  information  files and those of the Federal Bureau of
30    Investigation,  including  the  National   Instant   Criminal
31    Background  Check  System, and of the files of the Department

 1    of Human Services relating to mental health and developmental
 2    disabilities to  obtain  any  felony  conviction  or  patient
 3    hospitalization  information  that  which  would disqualify a
 4    person from obtaining or require revocation  of  a  currently
 5    valid Firearm Owner's Identification Card.
 6        The  Department  of State Police must act as the Illinois
 7    Point of Contact for the National Instant Criminal Background
 8    Check System.
 9        The Department of  State  Police  must  shall  promulgate
10    rules to implement this system.
11        In  this  Section, "gun show" means an exhibition open to
12    the general public  either   through  an   admission  fee  or
13    without charge for the purpose of displaying firearms and for
14    the sale, barter, or trade of firearms at the exhibition.
