 1        AN ACT in relation to education.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  School  Code  is  amended  by changing
 5    Sections 10-22.18b and 34-18.4 as follows:

 6        (105 ILCS 5/10-22.18b) (from Ch. 122, par. 10-22.18b)
 7        Sec.  10-22.18b.   Before  and  after  school   programs;
 8    grants.
 9        (a)  To  develop  and  maintain  before  school and after
10    school programs for students in kindergarten through the  6th
11    grade.  Such programs may include time for homework, physical
12    exercise,   afternoon   nutritional  snacks  and  educational
13    offerings which are in addition to those offered  during  the
14    regular school day.  The chief administrator in each district
15    shall  be  a  certified  teacher  or  a  person who meets the
16    requirements for supervising a  day  care  center  under  the
17    Child  Care  Act  of  1969.   Individual  programs  shall  be
18    coordinated  by certified teachers or by persons who meet the
19    requirements for supervising a  day  care  center  under  the
20    Child  Care Act of 1969.  Additional employees who are not so
21    qualified may also be employed for such programs.
22        The schedule  of  these  programs  may  follow  the  work
23    calendar  of  the  local  community  rather  than the regular
24    school calendar.  Parents or guardians of  the  participating
25    students  shall  be  responsible for providing transportation
26    for the students to and from the programs.  The school  board
27    may  charge  parents  of participating students a fee, not to
28    exceed the actual  cost  of  such  before  and  after  school
29    programs.
30        (b)  Subject   to   appropriation,  the  State  Board  of
31    Education  shall  provide  after  school  program  grants  to

 1    qualifying school districts, as determined by the State Board
 2    of  Education,  for  the  purpose  of  assisting   individual
 3    students  who  fail  to  meet  State  academic  standards, as
 4    determined under Section  2-3.64  of  this  Code,  and  their
 5    families  at  the end of the regular day of instruction or on
 6    non-school days at school  sites  in  the  qualifying  school
 7    district.
 8        If   a  school  district  receives  a  grant  under  this
 9    subsection (b), all students who are enrolled at  the  school
10    where   the   after   school   program  is  administered  may
11    participate in the after school program.  The school district
12    must submit to the State Board of Education a  detailed  plan
13    summarizing  its  strategy  for  recruiting  students  to and
14    retaining students in  the  after  school  program  who  have
15    failed to meet the academic standards.
16        The grants provided under this subsection (b) may be used
17    without limitation for the following purposes:
18             (1)  homework assistance;
19             (2)  supplemental programs; and
20             (3)   family-centered  education  programs at school
21        sites in the qualifying school district.
22        A school district may administer an after school  program
23    supported  by  a  grant  under this subsection (b) in any way
24    that it deems fit.  However, the  State  Board  of  Education
25    shall  strongly  encourage  the  school district to establish
26    partnerships with not-for-profit organizations or  businesses
27    for  components  of the after school program's administration
28    at each school site.
29        All applications for grants  under  this  subsection  (b)
30    shall  be  made  on  forms  that the State Board of Education
31    shall provide.  An application shall be filed by  the  school
32    district  with  the State Board of Education before the start
33    of the after school program. The  State  Board  of  Education
34    shall   adopt   rules   regarding   the  procedure  by  which

 1    application may be made for the grants  and  shall  establish
 2    standards  by  which  to  evaluate  the after school programs
 3    supported by the grants.  The State Board  of  Education  may
 4    adopt   any   other   rules   necessary   to  carry  out  its
 5    responsibilities under this subsection (b).
